Had Michelle on the phone first thing this morning as she said she did not have an e mail address for us. She is most definite that the build is on target to be completed by end of December, but that does not mean everything ready. Obviously they have legal things to get through as well. She was emphatic that we make no plans until we hear from them officially - so there is still some doubt, but she was certainly talking about signing end January, Feb timish. Looking good for Easter holiday!!!
Re builders mortgages: We have not yet had the details, but we did use a builders mortgage in America, and it was very good. So we will at least look.

When Michelle says that the build will be completed by end December but not everything will be ready, does she mean that things like landscaping, paths, roads etc. will be delayed, or does she really mean every aspect of the build will be ready, but that the period of admin/snagging etc. will take us into end Jan/Feb ? We will not be agreeing to complete if the landscaping is not complete (the contract does include it) - as they'll have less incentive to finish it off if everyone's paid.
Just sounding a note of caution that's all....

I think you are right to be cautious. I was so surprised to hear her voice on the phone so early this morning that I did not ask her. But I did think about it later on, and have e mailed the question about the facilities (at least swimming pool and gardens) along with the info she wanted re solicitors. There is no reply yet - but I will get back to you as soon as possible. I think our builders look as though they have been pretty good, but a cursory glance at the development forums on viva-almeria should convince people not to take any thing for granted.
An apartment in Spain is not much good without the pool. I have to be honest though, when we completed on a resort style condo in Florida, the facilties were not ready, and it caused a lot of bad feeling. This was the height of the US housing madness, and people were only given 3 weeks to complete all legal work or lose the property. I don't think there will be any pressure like that in Spain!

I would just advise a cautionary note as well, as residents of Los Olivos I would prefer to suffer the inconvenient in the short term in exchange for a development that is completely finished with completed communal areas and roads as well. The contract says, the sellers bind themselves to deliver the property along with its corresponding urbanisation, which shall be completed within the month of December 2006. If we take it that the urbanisation is the communal areas/access roads etc, than in my view we should they should be a consistent approach to accept and sign when the site is completely finished.

We spoke to Michelle at the begining of November when we were over for a few days and she said then that completion was still due for end of December depending on weather etc. she also said that the whole site including road had to be finished before it could be signed off also it could take 6-8 weeks for paperwork to be completed, we were impressed by the standard of the interior work and how helpful Michelle was.

Reply from Michelle to our e mail. She says that all properties will be transferred at the same time, and all will be completed. So will be the communal areas including pool. But she then goes on to say that the pool will be filled and functioning when the communidad is set up?????? Can anyone enlighten?

Linda, I can understand the thinking behind Michelle's comment about the pool not being filled etc. before the Communidad is set up: If you look at the thread on Community Pools in the Running a Community section then you'll see that we will need to set up our own rules for usage. This might also include when the pool is available, who maintains it etc. etc. - these things can only be sorted out when the Communidad is established and able to discuss and agree such things. I seem to remember seeing mention of the plan to have the initail meeting quite soon after we've all completed - I guess that might not be until after Easter as there's 80 lots of completions to get through. So for the earlier completers - you'll have to swim in the sea ! (or use other pools in Huerta Nueva - with their permission of course...)

OK - that is useful info thanks. Very different from here or US where for the first year or so the management of the properties is taken on by the builder or company chosen by them. Then handed over to elected board for management.
As long as we are swimming in our own pool by Easter!!!

Why do i keep reading the posts on various sites.Anyway to now share if you haven,t read .On this site under " Buying Property" Los Gallardos was mentioned as being one under investigation.This the first time that even so much as a whisper has been heard.
A few days ago on another site ( C.A ) Huerta Nueva.had a post from a resident saying that B.M.S were pulling out after Los O.which i think we were aware,for 2 years but that there were doubts about building the Commercial Centre &no mention of the recreation part or the "lagoon"
This prompted a reply from the forum,s "Global Moderator" who is a resident,that he waspursuing these rumours ,so far without success from B.M.S.
He also said that agents had stopped bringing potential buyers onto the site because it had become so "scruffy"
There was a reply from Lin who is a Los Olivian saying she had heard that the Commercial Centre was being subcontracted ,but expressing her natural concern about the " scruffy "comment.

Hi - and just to follow up - I did send a message to Michelle to find out what was happening with the commercial centre, and she has not replied.
I had missed the bit about Los Gallardos being under investigation, but remember, there are one or two smaller developments in Los Gallardos so unless it actually said Huerta Nueva, maybe it is not ours??

Hi everyone
We have all been looking forward to our new homes in Spain and all this talk is really starting to put a dampner on it.
I wonder if everyone should be contacting their solicitors in Spain and see where we stand about the completion of the commercial centre, tennis court and lake area, as I would like something in writing as to when it will be done that is legal & binding. I believe we could be in a strong postion at the moment with the balance of our properties not yet paid. This is after all our investments.
What does everyone think?

I could'nt agree more with Linda & Rob, i bought into Los Olivos not just because i liked the appartments but because of the development as a whole .I don't really want to move in without the surrounding area finished off ie the park & lagoon.

Below is the reply i received from Medsea estates when i put the question to them.
I cannot confirm regarding the paperwork until we hear from the solicitors,
in previous occasions with BMS this has always been a little later than
specified. As soon as we are advised that the apartments are finished we
will carry out a pre-completion snagging list, this is then sent to the
builders to advise the faults that need to be rectified.
You do not have to be in Spain for this - you will be able to snag the
apartments for yourselves when you come to sign. The builder is normally
given 15 days after you complete to finish the snags if they are not done
before completion. Unless any of the snags are major building defects you
will not be able to delay signing. We have been informed by BMS that the
development will be finished as planned I cannot comment on website
information.

Below is a email exert received today from Michelle at BMS in reponse to my question about communal areas on Los Olivas and Huerta Nueva generally.
I can confirm that the communal areas will be
completed at time of release of the apartments and the pool wil be ready for
take over from the communal management company.
The lake, at present, is under construction and makes an extremely nice
feature to the site and the recreational area has yet to be started but this
area is the responsibility of the local Town Council.
The build of the commercial centre will begin as soon as possible next year.
So that's me told!

I have sent an e mail to our advisors at Atlas asking them to address three concerns: Rumours of illegality, the Commercial Centre, and whether the town Council is aware that it is responsible for the recreational areas!!!
Will get back as soon as poss but don't hold breath - I tried to ring but noone there!!
We are still not too concerned, and are looking forward to going over - but let's see if we get a satisfactory reply.

I read with interest your comments on the communal areas of Los Olivos. We are on Jacaranda which is the development before yours. We had a contractual finishing date of December 2005 and we personally exchanged contracts towards the end of May 2006. I am posting some photos of the toilets on our communal area the purpose of which is to serve the pool area, as you will see by the photographs these toilets have never been finished a year on. Indasol the maintenance company for the communidad will not clean them or lock them because they are not finished. BMS for some reason still do not want to finish them. We have asked for reasons but have received none. Also there are pictures of the car park on Jacaranda, you will see from the photos that cars ground on the way down and also on the way up. As at last week when the photos were taken there were only 2 cars in the car park. We feel the car park is really not fit for purpose. The photos of the toilets were also taken last week. We find it impossible to accept that they can take our money so readily but do not have the professionalism to finish the job or even talk to us and give satisfactory answers. The toilets are surely a health and safety issue but this does not seem to bother BMS or the constructors. So when your agents snag your properties it is probably advisable that they also snag the communal areas. I am now going to post the pictures in the appropriate section. Good luck with your property completions.

Hi all
Just to let you know we have gone ahead & e-mailed our solicitor to find out where we stand regarding the commercial centre and communal area. We have asked them to confirm what our rights are if the communal area is not completed when we come to sign the contract & if the commercial centre is not started.
Keith thanks for the information about the toilets, we think it is a disgrace how they have not been completed, this must be a health & safety issue. We will have a parking area, so do not have to worry about a garage, but surely they have to put yours right? It could be that you will all have to get together to try to get something done about these issues.

Thanks Linda & Rob, good to see progress still being made,but can,t possibly see it being ready for Dec 31.We are setting off on Jan 2 to arrive at our rented appt on Jan5 ( Valle del Este )--now in time for 3 Kings.Will be on hand to liaise with our solicitors & B.M.S
A matter of interest----read under " Classied " adverts for "The Entertainer "--------land for sale 102000 square metres near to new development Huerta Nueva with easy access ,near to water & electricity with all paperwork.Any thoughts.?
Will try to post everything we learn,for those not over at that time.

We had an email from Medsea last week which said:
"A site visit was made this week and we were again unable to gain internal access to the properties. Please find attached photos taken of the development. We will revisit the site the week after Christmas."
The photos are pretty much the same as the ones posted already on the Shared Photos site showing the buildings looking pretty much completed from the outside but roads and common ways a muddy mess.
Hope you, Brian the family are all well. It was great to meet you all earlier this year. Have a great Christmas and let's hope the new year brings us some good news from Spain!
