We were in communication with Victor Sanchez this morning via an interpreter (our Spanish is not good enough) and we have clarified certain points which you may or may not know.
First of all, approximately 70 apartments have been contracted to be purchased or have already been purchased which leaves approximately two-thirds of the remaining apartments in the 21 blocks to sell. As you know, Victor has engaged Sagesa to maintain the development. Since we have been here we have seen gardeners tending the gardens and they are doing a superb job.
Victor commented that he is paying his share of the fees of the unsold apartments to Sagesa as they are under his control.
The electricity at the moment as you are aware is being supplied by Victor (Dream Hills) via a generator. (At the moment this is being supplied free to us so therefore no one has been inconvenienced by this. We know there were power cuts in the summer but all things break down.) Victor stated that the problem was not their doing. The main problem is that Dream Hills were sold the land with all the services supplied and in reality the electric supply was insufficient but Dream Hills did not know this when they purchasd the land.
Victor said that he is paying for a new sub-station/transformer out of his own pocket (translated via interpreter).
The situation as we understand it at present is that an agreement has been signed with Sevillana (the electric company for Andalucia) and that the works for the new sub-station/transformer have to be done by Sevillana workers/employees because of Spanish law so Victor is unable to give us a timescale for completion of works because he is totally in the hands of Sevillana. We believe if he could speed this up, he would.
As we understood the interpreter Victor will be looking at ways of recovering the costs back from Brisan (Marbella Club) who sold Dream Hills the land in the first place.
Also it was said that people who have delayed in completing have slowed things up and if we understood this bit correctly, under Spanish law he can recover all costs if Dream Hills so wish.
