Success.....Good News!

Following my lawyer taking out a summons against C.C.M. Bank and a preliminary hearing in Nov. My lawyer contacted me recently to say the Bank has deposited my monies under the Bank Gaurantees, into the Court Account . At present my lawyer is busy trying to get the monies transferred to his company account and then he will take out a further summons against the bank for expenses and interest on the monies, same held  by the bank since 2004.

That's excellent news and gives hope and encouragement to the many others who are in the same situation.

Why not post your news on the 'General Forum' on the 'Bank Guarantee' thread?

It would certainly give a pre-Christmas boost to people on other developments who are waiting for their day in court?

It all seems to have gone quiet  on this site since the beginning of December .I wondered what progress has been made with your monies

 we are still hopefull of getting our deposit back via the Bank Gaurantee but even though we also went to preliminary hearing in November we have not been notified that we have had our monies put back into the court

I would be grateful for any updates

I agree it has gone very quiet. I am in exactly the same position as you, had my initial hearing in court in November but no further progress. My spanish lawyer stated that they need to go back to court to claim against the bank. I have been chasing my lawyer up constantly throughout December because I am nervous about the expiry date of the bank guarantees (31/12/08). My lawyer has asked for more funds to continue the court action which I think is unacceptable. Therefore, I am planning to go to Spain early Feb to sort this out and give my lawyers a gentle push because there always seems to be an excuse my the developer,etc to delay proceedings.

If I hear any news from my lawyer I will let you all know.

Just to say - same for us - all very quiet.

I am also planning a trip down if we don't hear anything soon and will report back.
