Hi I am new to this site but hope someone can let me have some info,

My husband and I live in Switzerland and we started buying an appart in Condado de Alhambra last March.  We put down our deposit and we have paid the first €33'000. we are due to make another payment this month.  However, despèite having visited the site several times last year (last time in September) and seen the progress concerning the infrastructure and vilas, appart. I received a strange telephone call this week from someone evidently from Customer Servive at Polaris, indicating that they have delays. When pushed I was told that in fact they had not started the building of our apparment, which should have been ready around June 2009.  On top of this our solicitor in Spain ad our agent are not aware of this delay.  We have bought the appartment number M1230 (which we saw on the plan seems to be opposite the sports ground). We are a bit at a loss to understand what is going on and wondered if anyone can lay any light on this for us.  Any comments would be much appreciated.  We do not know if we should go ahead and make the second payment or not as we do not want to lose all our money if there is a big problem on the construction.

I would guess from your apartment number 'M' that you have bought on the El Mirador phase

Sorry to be the bearer of bad news but I think this phase has been postponed indefinitely. There are various threads on this site referring to this if you use the Search facility

Ask that Polaris provide an update to you as a matter of urgency as they should be offering you an alternative property

Hi Lea, first of all welcome to the site. With your apartment number beginning with M does this mean that you have bought on the Mirador de Alhama section of the complex. If so then the bad news is that this has been put on hold and polaris have been offering other apartments on the complex to anyone who bought on Mirador. If you check the "all threads section" of this site then there's some further info on what has happened. Apparently they will be starting to build the golf suites soon. The jardines, los naranjos and la isla de condado are finished or nearing completion. I find it strange that your agent doesn't know anything, you need to push him for info and call polaris before you pay any money. Good luck with everything and i hope it works out for you.

Welcome to the forum. Be careful about your next stage payment if you just don’t pay it you would be in breach of contract and could potentially lose some or all of you previous payments. You should have received a bank guarantee for your last payment from Polaris World, (not just a receipt) the bank guarantee is a document issued by the bank that is funding your part of the development and is supposed to be your guarantee that your money is safe, it is also a legal requirement that Polaris world have to issue this document to you. But they have been slow at issuing them, if you or your solicitor has this document then this should protect your payments you have made so far. If this document hasn’t been issue than you should inform Polaris World preferably though your solicitor that you will not be making the next stage payment until this document has been issued to you, a number of people on the forum have done this and held back the next stage payment until the guarantee has been issued.

As far as the delay to you part of the development is concerned I would ask Polaris world for an explanation of the situation and ask them and your solicitor what your options are.

I also bought on Mirador, but after looking on the forum contacted Polaris World - this has resulted in me changing  from the Mirador phase of Condado to Jardin 13.

when speaking to customer services I was informed that the Mirador Phase could be on hold for up to 5 years!

after visiting in November I decided to change, luckily the apartment I have moved to is positioned the same as the one I had picked on Mirador, but the apartments

available are limited.
