Hi everyone,
Things have gone quiet out there, have you all given up. I have put so much pressure on Morgan Stanley their vice president Christian Gaertner e-mailed me and so did his senior executive director Humphrey Edgington. They pointed out that they were not part of phase 1 but as they are a shareholder in the company for future developments they agree with me things need to be sorted to avoid further embarrassment for them. I had a personal phone call from the project manager Carlos Rodriguez, who promised a refund by 18th March, and has attended a meeting today, the results of which he will ring me about on Monday 9th March. Grupo Lar and Morgan Stanley are under no illusions about what I will do in terms of publicity if they are not forthcoming with the refund. I suggest that you all pester these companies as lawyers are easily fobbed off in Spain, you will get nothing if you don't fight and just moan about it. So stand up with me and fight.

I completely agree with Roy. That is the approach I took to get my money back from Grupo Lar a few months ago. Go direct to the top and involve their shareholders for full embarrassment factor. DON'T rely on your lawyers! If you sit there waiting for them to do "the right thing", you will have a very long wait.

Hi everyone,
Thank you Ed for your support even though you have had your refund you are ready to give advice. Everybody has to get on the case and not leave it to others. I had a phone call from Carlos Rodriguez, project manager for the Lar Sol development who assures me a final document is to be signed this Friday and he will be ringing me with the outcome of the meeting. When I e-mail him I always copy in Luis Pereda, managing director of GrupoLar, so there is no denying of receiving my e-mails. He has even invited me over to Spain for a meeting to show they have nothing to hide. This has all come about because myself and Ed have refused to be trodden on. You all have rights so fight for them. Ed has been my inspiration, if it wasn't for his advice I would have been tempted to hand over 5000 euros to proceed with litigation. All of you need to pursue the matter and not give up. I faxed a letter to most of Morgan Stanleys' branches in America and the one in Canary Wharf to get some response, so you all need to do the same. Good luck.

I have also been chasing Carlos at Grupo Lar but disappointed no final outcome last week as promised however today I recieved an e mal from Lawyers of Spain saying that the insurance company will pay up but only the deposit and interest no compensation! LoS say you have to sue to get compensation! Now i dont know whether to grab the money and run of fight for compensation!

Hi AJ.
The bank guarantee has been forced by me. I found out that the insurance company is Zurich International, so a couple of well placed e-mails over here and two days later the offer was there. At this moment in time take the money, if you then take Grupo Lar to court for the 50% compensation offered, you should be awarded 30% as has already happened in another case. This is what I will be doing.

Thanks I too am with LoS I asked if the group that went to court early april have got their compensation but got no answer dont want to risk any more funds if they cant secure compensation! Do you know what happened to that case? Will you use LoS to sue Grupo Lar?

I heard of a case early on in the year from Antonio Flores, the owner of LOS, that compensation was awarded at 30% down from 50%, which is still better than nothing. Olga is getting back to me with a cost for litigation.

I spoke with Carlos at Grupo Lar today it is not yet certain but we can expect cheques re deposit and interest to be paid to lawyers on 6th May this was confirmed by LoS . However LoS will not tell me the outcome of the last group to take out litigation for compensation and i doubt that they have been successful!
It would seem that Grupo Lar are to get ACC to payout deposit + interest and then they are to declare the whole thing "bankrupt ". unofficially the advise was that any compensation was not likely to happen as we would be at the bottam of the queue of debtors and we could therefore lose more money. They did empahise that of course we have the right to do that .
Can anyone confirm taht recent litigation has been in any way successful??/
