Hello
I wondered if anyone is having Problems getting repairs done by Procumasa and would like to do a joint legal pursuit of Procumasa in order to get things done.
Also to get the pool open and to legally pursue whoever prevented them opening it this summer, also legal with regard to getting water meter money back.
Enough is Enough and it is time to take them on legally before all guarantees run out.

We were in our house in august/sept and spoke in our last week to Felicidad Miralles about this items.
She told us that the snags will be done but they don't have enough workman and last but not least, the money to give our after sales. She told that they started up their guarantie works.
About the swimming pools is another question. About this item she told us that they will handed over the swimming pools to the community and talked allready about this item with the community.
I agree tot take action but give it some time more but only for this year.
Sorry for my English. I am from Holland.

Thanks for your reply Ruud
Feli told me the same i am hoping they stick to there word, i would like to take proceedings on principal because it can take a long time to get to court and i am hoping they are still trading when court id reached.
Procumasa also blamed our President for the reason the pools were not open saying that she was on holiday ao not sure who to believe.

I think the lack of response to this thread is indicative of the interest shown by most of the residents. The majority are more than content to pay money to Procumasa on the threat of water disconnection, but not prepared to fight for their rights!
The pool saga is a bit more complex. Procumasa are exploiting the splits amongst the committee and the residents etc. to cause confusion. If there was better communication within the Urbanisation then I'm sure there would be better understanding.
I'm not sure wether we do exist as a fully legal community yet so the talk of handing things over is (in my opinion) a bit premature. Also there are no funds available for the maintenance of them if they were to be handed over - another consequence of us not being a legal entity.

Hi everybody,
Dennis made a very good point.
Similar problems can have a solution when arms join forces.
Probably it is not a point of apathy because i noted on reference date, sunday September 27th that 124 readers have seen this subject so there is enough interest to think/write/talk about this item further otherwise we pay the after sales from Procumasa by our selves.

Thanks for your points Dennis and Ruud
Another thing that is a problem is finance, a lot of people possibly do not have the money to go legal with Procumasa but will jump on the band wagon if others finance it.
With regard to the Committee if one person is the problem then if we had a solicitor for all we should take legal action against that person the situation with regard to the pool is totally out of order.

I'm not sure the pool situation is down to one individual on the committee.
Procumasa want to hand them over. But before they can be accepted they need to be re-snagged by somone who knows what they are looking for - get it wrong and it could be expensive. Even then if they are acceptable then there is maintenance and insurance costs to consider. If only one pool was opened then the costs would be lower but who would pay? Unless it comes out of the non-existent community budget then it will be down to the few making donations.
The only way forward I can see is to put pressure on the Administrator to call the long overdue AGM. He should then present a budget for the year ahead (which should include costs like these), let the people vote in a new committee and then we can present a united front to 'fight' for what the Urbanisation needs.

Bang on Dennis....
We need a decent committee who will look after the needs of all the resident and be approachable and available when needed.
People who will fight for what is right and not keep arranging the next meeting to arranging another bloody meeting.
Fancy applying Dennis????
