Whilst I can understand the frustrations of some owners on Phase 3 regarding access I have to agree with Coopsy that this is a stupid idea with potential dangers for all of those involved, not least of which would be being hit by a ball. The law in Spain is very different from that in the UK with regard to personal injury claims as in Spain you have a responsibility not to put yourself in danger in the first place and my experience has been that the courts will not support any claim where the injured person is at fault.
I have no idea of what the job description of the Security staff involves but I imagine that they are tasked with protecting property and owners within the development and if that means stopping owners putting themselves at risk walking on a golf course then they are only doing their job. The 3 euro insurance which we pay when we play on the course is to cover any potential claim by another golfer or any damage caused by an errant shot which hits golfers or property on the course. It only applies as I understand it, to people who should be on a golf course and to property adjacent to the course therefore the members of the protest would not have any protection at all as they should not be on the golf course.
When faced with a number of people walking on the golf course who are not playing golf, security would be well within their rights to tell you to get off the course as you are trespassing on a golf course which is a private business concern for the use of golfers who pay to be there. If faced with a large number of people security will simply call the local police and you will be removed and potentially charged and rightly so as you have no business on the golf course.
I think that there was another posting on this forum stating that at the Phase 3 AGM someone has volunteered to look into this issue on behalf of the residents and it would make a lot more sense to contact the person who is doing this to see what the options are but I doubt that a protest walk is one of them.
If you were sold the properties on the understanding that you would be able to get to the clubhouse quickly and easily then you have a serious bone of contention but protesting in a more acceptable fashion will get you a lot more support from other owners, particularly golfers, than this idea.
