Hi all,

There is a design fault with the buildings on Phase 1 (possibly other phases too) - which essentially stems from the lack of guttering and drainage on the individual terrace areas. From most of the apartments in each block, if you wash down your terrace the water drains down onto the below terrace and therefore is inconvenient from everyone. At the last AGM (in my black - 53) Resortalia noted that owners should avoid washing down individual terraces until a remedy has been devised. 

When I spoke to Resortalia about this, they confirmed that the building developer would not make any amendments or remedies. See the response from Resortalia below:

In relation to this issue we are sorry to inform you that the builder developer is not going to solve anything, they say that the buildings are build according to the plans and that they don’t have to touch anything.

 

 

The solution would be installing guttering, but we haven’t been able to find a kind of guttering that doesn’t affect to much the façade of the building.

 

 

 

 

May we inform you that this aesthetic change must be done by each owner and the community has to evaluate the kind application that is going to be installed, in order to maintain the harmony of the buildings. "

 

Now, I am personally not convinced with this response from the developer - I believe this is a design fault and therefore according to Spanish law, this must be remedied by the developer (therefore they should assume the cost).

 

Also, Resortalia are now not responding to any of my emails when I'm asking for an update on what to do!

 

Has anyone else heard about this issue? Does anyone have any advice or suggestions?

Have you tried speaking with anyone from La Torre?  I am sure the aparment blocks there suffer exactly the same fate and as they have been around a lot longer, they may have come up with a solution?  It may be worth a try.

 Hi Kim,

Good idea - I'll see if they have the same problem at La Torre. Although, I believe the building types are very different! 

I'll let you know how I get on as it affects everyone on Terrazas.

Revisiting this issue - I have checked with friends on La Torre and the building types are very different. It seems that Polaris have put added thought into the buildings on La Torre by adding proper drainage so that raised level apartments can wash down their terraces. Terraces on TLTGR do not have guttering, and subsequently we're being asked by Resortalia to not wash down our terrace until there is a resolution to this issue. I believe that Polaris World are going to make owners pay for this amendment, but by Spanish law this could be classed as a design or building defect - this liability would fall to the developer.

 
On most issues I have found Resortalia excellent; however they have point-blank refused to respond to me on this issue. Even after sending around seven emails. I have therefore requested that this issue is added to the AGM in the next couple of weeks.
 
I just wanted to make everyone aware, as we (as owners), might end up paying for a defect caused by Polaris World. Whilst the cost shouldn't be much, I want to exhaust all legal defensive possibilities first - as this would affect most properties on Terrazas.
