We bought a menta property on phase 3 back in 2006 (near the entrance) with the intention of moving to Spain. In 2009 we asked our solicitor to arrange for the execution of our bank guarantees as it was becoming clear that it was highly unlikely that the property would ever be built.
The two banks holding our guarantees refused to release our money and we commenced legal action against both banks. The judges in the ordinary court accepted our lawsuits but we lost both cases. We took the cases to the court of appeal and won a final judgement against one of the banks last month (the other will follow shortly).
It has been a highly frustrating process but our solicitor (Spanish) has been fantastic throughout the case, always keeping us informed as to what was happening.
