Hi,

Just found this message board and sad to see it's not just me who's frustrated.

As a lawyer (albeit one in an area which couldn't be any further from spanish real estate purchase...) I'm tempted to look at the legal process re trying to get my money back (plus interest), in addition to taking action against Parador, who clearly must have known about the status of the project when I fell for their subtle charms.

Has anyone else 'tested' the legal position re refunds and legal recourse for whatever the Spanish equivalent of mis-selling is?

I'm in a very fortunate position insofar as for me this is an investment property. I appreciate that for many others of you, your property in ACC is a new life, so  must be very concerned about the position of your property.

I'd be delighted to get any views or comments, as to be honest. I'm flummoxed ! (Not often a lawyer says that....)

my feelings are that if we all ask for compo will huma use cheaper materials to make up for their losses

Think that Huma may well use cheaper materials/builders anyway - to maximise their profits, and to offset the delays so far.

I spoke to Pilar at Huma yesterday, and yes compensation is to be awarded - she said it will depend on the individual - waiting time, amount invested etc.  She also said that deposits would be refunded if people choose to pull out, whereas back in May, she told me the complete opposite!  Either Huma's legal team have put them straight on their obligations, or the right hand doesn't know what the left hand is doing...

I think whatever we do, we need to act as a cohesive group as much as possible - if people do decide to take legal action, then we should all use the same lawyer - much more intimidating than people acting in dribs and drabs over a period of time.

A Spanish judge would also be naturally more disposed to sit up and take notice of a group action, IMHO.

I think you are right , it is a case of the right hand not knowing what the left hand is doing.

In our experience everyone we have contacted has told us something different. No-one seems to know what they are doing.

Yes it would be an advantage if we could collaborate and use one legal person as I don't think anyone is really interested or appreciates the amount of worry and stress this has caused buyers on ACC.

Someone must be collecting huge amounts of interest on our investments. People have said that the price increase on our property will compensate for lost interest but I think that because the market is very stagnant this will not be the case.

I wonder if there are any people out there who have bought a number of plots to sell on  as an off plan investment, our agent tried to persuade us to do  this for a 25% return on completion . Just as well we didn't take her advice!!

Someone on Devwatch is trying to contact almeriajohn in order to offer him 6 properties, sounds like an investor who is going to get his fingers burnt.

 

If you are pulling out and need another solicitor then contact jethro (spelling?).  He has passed on his solicitors details to a number of others in the same situation, so this may be the 'one voice' that you should consider using.
