As many are aware the 1st AGM takes place on 1st June for blocks 1 & 2 .
We as owners in block 2 intend to be there and would encourage as many as possible to do the same. It would appear that the 1st thing we must do is try and get owners elected as Presidents and relieve Ammex from any responsibility as regards to running the site. We believe that the costs that they sent us are ridiculous and the sooner we as owners take control the better it will be for everybody who has a financial interest in the site. I urge any others from Blocks 1 & 2 to contact me so that we can make sure that if anybody cannot attend the AGM that they give a proxy vote to another owner to use on their behalf. We also think that the 1st item on any agenda after the election should be to join with the other three communities and be as one as this would encourage a joint venture to improve and manage the site in a professional way, and in doing so increasing the chance of future income.
If there are any owners in Block 1 & 2 that wish to be the president please reply as it may be a good idea for as many owners as possible to get together prior to the AGM ( in England if that suits the majority ) I would be willing to organise a venue that would hopefully be ok for everyone to get to.

I agree that priority is to get an owner President if we can, but as discussed at length in another thread (Recent Ammex Email) I think it was, I disagee with getting rid of Ammex for all the reasons I, and others outlined in that thread. The problem is not with Ammex, it is the President (ie Interlaken). The President gives orders to the Administrator regarding the running. Whilst rules, statutes etc are agreed / changed at the AGM, it is the President who is in control of the day to day running of the community. The administrator is not an owner and has no rights, they are paid professionals, necessary with large communities.
Equally I think one community for the whole site is to unwieldy. The 4 Presidents need to work together in the day to day running, it is too large a task for one single person. I am confident that once we have four owner Presidents we will all be working towards the same goals - a well kept and properly functioning site which will, in time look beautiful and a good investment!
We still have not completed and will not do so until our snagging is done, there are some items which have to be done by them. We're also waiting for our mortgage finalisation (very long winded), however, we are planning to make sure that we have completed by the time of the AGM in order to ensure that we have a vote and not Interlaken.
We are block 2 and will do our utmost to join with any meetings for blocks 1 & 2, wherever they are located, the more active involvement we can get, the quicker the site can start to improve.

Hello all,
Apologies for our . ignorance but don't want to miss the fundamental issues!
Would be grateful if someone would explain if & how the communities have been set up within CDS. Do we have to have separate communities/presidents and AGMs? Aren't we better having one set of goals/standards for the whole comminuty as one?
We completed on block 21 in December & snagging has just been completed, so things are moving for us now at last.

Whilst some people have suggested keeping 4 communities this will only lead to problems regarding finances as one community will not want to spend as much as another. The idea of one community and one president made up of a representative from each block gives every one a fair voice on decisions for the site. This is another reason why the owners must take control as soon as possible to ensure the future progress for the site.
The reasons for ditching Ammex are simple those of us that have completed have already paid substantial amounts of money to Ammex to run the site and have now been given a list of costs so that we can pay some more.
Some of these fees that they claim to be paying out on is better suited to an Enid Blyton novel, They have been paid over 300.000 euros so far and the only costs they can justify is pool maintenance, street lighting sometimes, water for some of the gardens, A couple of cleaners washing a few stairs, 2 maintenance guys doing very little and recently a part time security patrol. Someone is making a lot of money from us already.
The site problems are not caused by Ammex but the developer and it is with MLH that the focus of claims should be made.

The only trouble with getting Ammex or their president out is that we need at least 25% of owners to either be present or register their vote at the AGM. it's all well and good but only about 50 people know of this web site and there are over 520 apartments on this complex they all need to know that this could affect them.
There must be a way of getting a list of owners from MLhomes so that all owners can be contacted.

We are in Block 18 so I do not know when our AGM will take place but I believe that we want to be consistent in the early days.
I would advise caution here - where does the fault lie - with Ammex per se - or down to the current prevailing arrangements?
What is the experience of of other communities that have got rid of the established administration?
I would only vote to remove them if they have failed to deliver on our instructions - the past is unchangeable. What we need to concentrate on is going forward. Remember that we are not (unless anyone jumps out and claims to be) expert in this. Lets walk before we try to run

I have asked Ammex for a list of owners in PM1 as I think that they may not release other community members.
I also believe that if we act as one and appoint an independent Spanish lawyer once Ammex and or Interlaken do not have control we as a group will benefit but this can only be acheived once every owner is on board.
We are in PM1 and at the AGM we hope to get started the process of joining the site to start the progress for the future.

May i suggest you read the article below regarding the "Community and the role of President"
We dont need 25% of owners to vote out/in the president, just a simple majority at the AGM.
The 25% i think someone is referring to is if the president refuses to call a meeting 25% of owners can legally call a meeting if the president refuses.
I think we should give Ammex a chance once we install our own president and to change Ammex immediately would be very risky in my opinion. They have to follow what we vote at the AGM and after that whatever the president requests through the owners.

I think you are right, the purchaseers need to elect thier own chosen president of the communities then give Ammex a chance whilst we also find our feet and understand other options available which will come through experience. Ultimately we need to be stipulating how our monies are best spend and how to get and negotiate the best deal with Ammex or any other service supplier. Rome wasnt built in a day ,but we do need to be collective to get anywhere.
We need to support blocks 1 & 2 with their AGM in June and then learn from how it went from them ensure each subsequent AGM inthe comming months is well attended with a clear understanding of what we want and how to achieve it. It is a tall order but to have to try.

I agree with previous comments regarding keeping Ammex on board for now but we must try to get some of the owners elected to encourage the future progress of the site is done to suit the investors rather than a company purely involved for profit.
It would be handy if any owner from the site is Spanish speaking and or possibly a lawyer.
This will be a long process but hopefully everyone is in for the long haul and will then see their investment grow as we expected from the start.

One item we havent covered much which is very important is what language is used at the AGM!
I have read the language to be used is normally the laguage of the majority of owners, but this should be voted on at the 1st AGM so i suggest this item be put on the agenda.
I am led to believe the vast majority of purchasers are English and if so i presume this would be obvious choice to use. It is also possible to use an interpreter at the AGM should this service be required.
The minutes of the AGM have be published in Spanish (this is a legal reqirement) but it is normal to have a copy in English (or the prefered language of the AGM as instructed by the owners)

Out of respect for the considerable Irish contingent amongst the owners I suggest we should refer to the majority of owners as being English-speaking rather than English !
