Hi there, I've just received a call from some solicitors offices in Malaga asking if I want to pop in and denounce the company in the hope of getting my money back although I doubt I'll receive anything. I'm not parting with another penny regarding this mess, not without any guarantees anyway. I'll post a message once I've met with the solicitors. I'm going to suggest that they take a commission if monies are paid back rather than give them thousands beforehand! I cannot afford to lose any more money over this mess, the stress would probably kill me anyway.
Apparantly, some chap called Gustavo has been given one sentence of 2 years but that's just for one case, if he's tried for more he'll be sentenced per case, I think that's what the lawyer meant!

thanks for the info. I have concidered contacting the local authorities in Malaga to have them to explain how they allowed the situation to get so out of hand, and to put the blame at there door step, and seek recompence from them, seeing as there law seems to be pathetic in reacting swiftly enough to return peoples money. All assets should be held by the courts so creditors should be paid back in full. Be interesting to see what the solicitors have to say in the reaction to the prison sentence handed down. Is that not proof enough of guilt and the fact that they should be made to hand over all they own in property and investments, especially monies in panamanian bank acc's! let me know how you get on,

It´s an awful situation and I totally agree with what you´re saying however, the Spanish authorities would never pay out, I wish! listen, if like me you want to continue this story in private you can contact me at my work address here at the town hall in Frigiliana, just access the frigiliana web site and search for my email which is extranjeros. Tried to send you the address in this message but it wouldn´t allow it.

Dear All,
it is very common that the purchasers that have paid funds to buy a property ends without anything if the construction does not come to the end. The developers are bankruptcy or all their assets are attached with a mortgage which makes impossible to obtain the funds paid.
We have been working on the past years on the possibility to claim to the bank for the funds received as deposits when purchasing a property. According to the law the bank has a responsibility when it comes to the assurance of the amounts paid by the purchasers in the developer´s bank account. We have obtained positive results at court in the last years.
Due to the current financial circumstances, what at the beginning seem very difficult to achieve, in the current days the courts have decided in different judgments that the bank is responsible and it has to return the amounts paid.
If any of you are interested in knowing more about this option, please let me know and I will explain you more. In fact, we can have a meeting if there are a number of people who could be interested.

Many thanks for the information it is greatly appreciated however, does this apply to those of us that failed to obtain bank guarantees?
Personally I am not able to spend another penny on this obvious act of robbery! I would rather lose the money than spend any more time and money fighting for it, especially when there aren´t any guarantees.

Hello,
yes, it applies also to those who did not obtain a bank guarantee.
We have obtained positive results at Court already in the north of Spain and we are trying now to do the same in Málaga as there are a lot of developments which are not finished and the purchasers did not receive the funds back.
If someone wants to have more information we can have a meeting.
I understand that there are people who would rather prefer to lose the amounts paid. It is a personal option but we just consider that it is good that everybody knows that there is a last option.

Thanks for the positive information. If we were to come to you for assistance, how large will our costs be, and how long do you feel the claim will take? As like Kevin, i have spent alot of money already, but am prepared to put more in knowing i will refunded my deposit and costs back. Do you have your costs covered by a sucessful outcome?
