hi everyone,i along with 5 other couples bought properties on the said site,after getting limited imformation through san jose at the best of times it has now come to a stop,we don't seem to get any reports from them at all.if any one can shed any light on any progress that is happening it would be greatly appreciated..thank you mark

hi we did the same have since cancelled our contract.
don't think its going ahead now we changed our solicitors from psi to Guadalupe
who has got us our money back if I was you I would start to claim you money back it could take up to two years .
if you read the messages on this site you will see the truth sorry for the bad news.

HERRADA DEL TOLLO __ August 2013
Herrada del Tollo have been notified that the sentence of the court has at this time, annulled the proposed plan of Santa Ana del Monte – Jumilla Golf. The reason given is that the Court believes that the Town Hall of Jumilla should have had the water resources documents for the development plan before rather than after issuing the licenses.
I am writing to inform you that as a company we are working with different alternatives arising from that judgment. Some of the options could be: to appeal that sentence, to present a remodeled Development Plan using the favourable report of the water resources that we already have or even to start other legal actions to defend our rights, as all the Works were done after the approval by the Town Hall of the Development Plan.
We are in the first instance applying for a meeting with the Mayor of Jumilla to discuss the situation and what would be the best and fastest course of action to find a solution to help our clients. We have not yet had a confirmation of the date for the meeting but we hope it can take place as soon as possible. The purchaser representatives will also be invited so they can put the purchaser point of view across and to be able to know directly what action will be taking place.
In the next few months, we will keep you up to date on any news and the action plan that we are going to undertake, we will continue trying to find the best result possible for all our clients and will keep in touch with the purchaser representatives.

does this latest ruling make it easier to get our money back,as with the project being anulled ,,in other words there isnt one anymore.the firm hasnt actually gone out of busness,it just cant deliever the devolopment in which our money is invested in

I am so sorry for all of you but so very glad I have been proved right, when I told everyone 5 yrs ago, they would get Nada from this company over the 5 yr period, when 52% voted to keep them in business you should all have voted against HDT and put em out of business, their commercial arm built the biggest commercial centre in a spain and are prospering, whilst all SADM buyers are left with nada Please, All of you now get your contracts cancelled and get the hell out of this farce you will get nothing if you don't get your acts together

Hi All,
We finally recovered our deposit through an action taken against the banks by our Abogado (Martin in Abolex - many, many thanks). We would strongly advise anyone that has paid over a deposit to insist their lawyer takes the necessary steps to try to recover it through the courts by taking action against the banks that did not issue bank guarantees. If this is a route that your current lawyer is not prepared to go down then we would advise that you seek the services of a Lawyer that has already successfully recovered their clients deposits.
This development will never go ahead. The following figures were given out at a meeting between San Jose/HdelTollo management (including Almudena) and clients in an hotel in Dublin prior to solvency vote. The original plan was for 10,000 units but only 1,500 deposits approximately were ever received. Less than 300 of these 1,500 customers received bank guarantees meaning that spanish law was broken at least 1,200 times. . The only way the build can go ahead is if those clients that have already paid deposits decide to continue with their purchases as this is the only income the company will have for this particular site. The building of an hotel, equestrian centre and even one golf course will simply not be viable.
Please, Please take the advice of Great Auntie Linda - seek the assistance of a decent abogado and try to recover your deposits before the situation deteriorates even further.

Can anyone who has got their money back without a bank guarantee please give me contact details for their solicitor, I appointed one in 2008 paid for notary and their fee etc and heard nothing since. I get updates from San Jose but frankly was about to give up having not looked at this forum for years and see some lucky ones of you have made progress. Any help of name of solicitor I can trust would be great - if anyone one is in same position and wants to join me I am happy to try and co-ordinate something in a last ditch attempt TO GET MY MONEY BACK

We used Maria at Costaluz to get our refund from the bank just use the link on this site to contact them, they are already preparing group actions which will keep the cost down.
Other lawyers are now also getting results so it must be worth a try.
We had no bank guarantee but we received our money back 18 months ago along with costs and interest.

i have just had our deposit put into my bank the long wait is now over.
thank you guadalupe and colleagues at gmlegal experts.
i can honestly recommend guadalupe ,i only had a copy of a bank guarantee
guadalupe won my case and got me the full deposit back.

Hello all,
I am so pleased for all of you that have manged to get your deposits back..Well done. We awere going to go down that road but we never got a bank guaretee in the 1st place! We have however been offered a key ready property on Playa Golf at a reduced price and all out deposit will be transfered which we are considering it seems the easier way to recoup our money.. I would be grateful for any advise you may have . I am truly sick of all this now so much fot 'I want my house'

I live within spitting distance of Playa Golf please dont touch them with a barge pole( i too was offered this) most of these properties belong to the banks and have 2 mortgages on, get a good solicitor like Guadaloupe or Maria Costa and fight for your money, the presidence has already been set for a group bank guarantee which covers all the HDT stock. I am sure if Nigel Weatherall sees this post he no doubt answer the same as I have and will vouch for this statement he was almost stung

Hi. I initially paid 300 euro + power of attorney costs to appoint a Spanish solicitor but have not heard anything from them for years and years and now I cannot get a response to emails or phone calls. Having seen posts of people getting deposits back I have contacted Costa Luz Solicitors, they have sent me forms and requested copy contracts etc and then will then assess my chances of getting a refund and estimate costs - if you pm me I will let you let you know what response I get from them - I had no bank guarantee
