Yes sad to say Linda is correct, dont touch Playa Golf or any other former SJ \ HDT former develpment, they all have at least two mortgages \ building development loans stacked up on them which prevents final purchase of these desolate empty properties. I was "conned" if thats the right word by an Englishwoman Joan Soane into trying to buy some of these Playa Golf properties and "swap" in our HDT deposit contracts. Still not had the energy to try to get my deposit back from her yet. (But the time is coming).
On the main event getting your deposits back out of HDT or the Banks - go for the banks they actually have money! Me & my wife Jo are part of a class action of ten of us using GM Legal Experts - Guadalupe Sanchez, to get our deposits back using the Spansih Law \ Article 57/68. Hi all Things look good for a result from the court within the month. Guadalupe is it likely if we get a positive result , the banks will appeal. And if so to what timescale could this take.

Hi Gambles
Had a recent updat from the builder who says for those who voyed NO to the build we should receive 10% of our deposit this year, with a further 50% next year (if they have any money or don't go bust)
They plan to proceed with the developement but it will be downscaled, but still waiting on planning permits etc. If you voted yes maybe they don't send out updates?
I also started a class action with Guadalupe back in December and am now informed that now others have signed on Court action is to proceed shortly.

Nigel, Regardless on how the hearing went, I think we will just have to wait for the judges sentence which I hope will be within a month. At least we are in the system and closure is on the horizon ...

Was in the area at the weekend and popped over to see what was happening at Jumilla. The answer is nothing! The only thing there is the now rather shabby looking entrance gate, the original showhouses and a couple of cranes. Even the concrete silo thing has gone. The whole thing is still fenced off, forgotten about and left to rot. All very sad :-(

Hi All
just got email from GM Legal. we have won our case against the banks for the retuurn of our deposits and interest. there is a problem with those who signed up with the builders offer of a refund, however I spoke to Monica today and she assures me this will be sorted within the appeal we will all be joining in , as the el judge decided not to let us claim for legal fees.
for those that did not go for the builders deal, we will be claiming our initial deposits back within the next month and with any luck should have the bankers draft from the court within a month after that. But lets not forget this is Spain.
This is still some great news after years of misery, pop, fizz, glug

BANKS SENTENCED TO PAY 800,000 EUROS PLUS INTERESTS TO SEVERAL PURCHASERS OF SANTA ANA DEL MONTE WHO NEVER GOT INDIVIDUAL BANK GUARANTEES, AS A RESULT OF A CLASS ACTION LAWSUIT
SGR & BBVA have been sentenced to pay about 800,000 euros plus legal interest to several purchasers of Santa Ana del Monte (Jumilla), who joined a class action lawsuit over enforcement of generic bank guarantees, as the court understands that the lack of delivery of individual bank guarantees can't limit the purchasers' unwaivable rights established in the 57/68 Act.
