Hi All,
Just had an email from Costa Luz Lawyers stating that the case against Aifos and the bank involved has been submitted to the first instance court.
The next step is for the opposing party to answer the lawsuit.
Has anyone been in this situation before and how long does it normally take to get a court date?

Hi all,
Just joined the site so,
I bought a property from drawing at the Cortijo de Torreblanca site many moons ago, I saw the headline about the court case but nothing more.
can anyone shed any light on the current situation as there is little or no information on the internet.

I'm in the same boat as you - bought an apartment in 2003, still waiting for it to be built.
It's a long story but there is hope. I've got some good news for you - you have a very good chance of getting your money back. I don't seem to be able to send you a private message - perhaps you haven't posted enough posts?

fazarelli, my father is involved in this project. My brother and I are now handling his affairs as he has regretfully been suffering from dementia. We have no clue what is going on. Good Morning,
I am unsure if any of the original members are still checking in on this forum but I believe it is still worth my own update on a claim against Aifos for the refund of our deposits.
I received a phone call from our lawyers in Spain who informed me they have won a judgment from the courts against Aifos's bank who under Spainish Law are responsible for all off plan deposits. We are hoping to receive more positive news over the near future

Hi,as our solicitor has not been in touch with us since the new spanish law came in we are going over in october to see him and change solicitors (it is just finding the right one ) then hopefully we can put a claim in for our deposit ,hope you hear some more good news soon

As a guide to the question of timescales.
Our claim was in the preliminary courtlast October and was submitted to the first instance court straight away afterwards, we had a court date of June and thats when it was heard. So you should really have a date from your solicitor quickly for the first instance hearing, and then its around 7 months.
Our first instance hearing was then sent to the main court case, the trial, and thats taking place next February.
So your more than a year away from the trial I guess, but keep on top of the court dates, I reckon you should know by now what that date is to be.

I finally got a court judgement saying weve won our case, and no appeals are possible by the banks!
Taken about 3 years to get this far. Just waiting for the money to be returned now.
