has anyone recorded a letter through their solicitor stating the tax office has been in touch stating the following .......Our offices have just received a letter for each of you from the Regional Tax Authority (a copy of which is attached), in which they claim that the value stated in the Transfer Tax declaration (i.e. the price which you paid for the property) is lower than what they consider to be the Minimum Market Value of the property.
the tax office is asking for another 4000euros each by their calculations. My solicitor has said they will appeal but this will cost us 800euros each....any advise or knowledge of any of this ??
what we paid for it is what we told the tax office so how can they change the goal posts ? When we didn't buy from them ?? I also think if we have to appeal 800 euros each is steep for solicitors fees !!

It's a bank repo. We bought 3 years ago. Their property value calculation is very out if date as there are property's selling at less than what we paid to date. I've just read up on the extra tax and I get the appeal process and my solicitor has stated they are generally sucsefull however they are wanting to charge 1,400 for the service which seems a lot for what should be a letter and potentially a independent survey.
Im assuming everyone on the resort in my situation are going to be getting this letter through !

Its yet another Spanish rip off,Spain should be very glad of people buying a property & spending money on taxs goods etc. But no lets rob some more off them, its a shame you dont get a refund in tax when you sell at a loss .And solicitors are also out to rob you, why are the fees based on per person x2 so if people have bought a property as in 2 couples bought together 4 people ( of which my frieds have ) whats that all about. The fee should based on the property. Im looking to buy again but i will also be looking for about 5k off to cover this rip tax when it comes.

Agree newworld so frustrating !! Especially as I had no idea till I read the email from my solicitor 😁 and I've asked why they are charging me twice when it's a tax based on one property I've asked the solicitor if they will review their cost but I can imagine there's a captive market, so unlikely 😞 if they are going by market value then surely they owe me money LOL as it's less now then what I paid !!

yes that's what I am doing I've already seen one at 500e but it's balancing the trust. I don't want end up paying huge fee and the no win and still have to pay the full tax 😞 the joys !😄

Try Amaya(solicitor) based in the town centre in La Torre. She has had been successful in appealing these taxes. We have used her on many occasions and found her to be excellent .pm me if you want her details

The people that bought my villa on La Torre used Amaya she was very good, if i buy again i would be using her. The guy i used was cheapish but you get what you pay for, he is not to bothered about getting my 3% back 2 years on.His words are leave it with me lol.
