Just thought I would post a new thread to see what the current status is:

Has anybody completed on a unit in Aureus ?

Latest update from Lawyers / Estate Agents ?

The only information we have is Refunds will start to be issues once people start to complete on the units

Last week my lawyer told me they had agreed a figure and were awaiting  acheque from the bank.

This figure included a return of my deposit (84,000 Euros) plus interest (15,000 Euros).

Waiting in anticipation.

Following my last e-mail, I have now received a cheque, refunding my total deposit plus interest.

I am just glad this whole saga is now over, after nearly four wasted years, and after seeing photos of the complex I am not too sorry to be missing out.

It does not look too much like the artists impression, on the front of the brochure.

Hi King

I have decided not to go through with completion and have spoken to my lawyer who tells me that she is having problems retrieving deposits from Banco Pastor, I am obviously extremely worried as I "invested" 50K over 2 years, could I have the name of your lawyer, perhaps he or she could help me on this one, am so tired of all this.

Although I had to wait acouple of months, my lawyers were always confident of retreiving my money plus interest.

Nice to hear positive news!

We applied for a refund last October and are still waiting. Does anyone know whether they are dealt with chronologically, or does it entirely depend on how effective your lawyer is! We recently visited the site (19 June) and were amazed at the progress and the huge reception. The poor security man was new and knew NOTHING about when it would be finished, how many were sold, etc.

Hi as there hasn't been much movement on refunds , well at least not on the site ,

I was wondering has anyone has recently received a refund?

We have just been told by our Lawyers that the Lawyer dealing with our case has left the company without any notice.

It seems its another waiting game.

If you go back to the postings of September to December last year you will see that quite a few of us have had refunds (thank God).

It is all down to how effective your lawyer is and it does help if they had got the paperwork for the bank guarantee, in which case you will get a refunfd plus interests (this % does vary on the rate quoted in your guarantee as their were some stating 6%).

Because we wanted the money back asap and put this mess behind us our lawyer did a deal and got us refund plus 4% although we had been promised 6% this was because she had trused the administrator to honour his first offer, then the administrator spotted the mistake and back tracked. If my original lawyer (same practice)had got the guarantee as promised back in 2005 it would have been 6%. The young female lawyer who was given about 11 clients to help did an excellent job for all her clients because she literally hounded the administrator and he responded with action. They  (Spanish Lawyers and so called estate agents) have had it too easy for too long and now they have to work for their clients - some clearly do not know how or cannot be bothered!!

We are still enoying our place at La Finca Golf in Algorfa, 15 mins from Guadamar Del Segura, south of Alicante near the border with Murcia- a diffrent experience completly and can recommend to anyone but it helps to have the experience and know who, when were and how much!!!

We have spoken with our new lawyer who now informs us we should expect refunds towards the end of the year. (October at the earliest)

The administrator told her that anyone who applied for a refund after November 2006 will have to wait until properties are handed over and final payments made. All refunds made to date were to clients who requested refunds prior to October 2006.

My understanding is refunds requested prior to October have been re-paid during 2008 from January to June

Can anyone who requested a refund after October 2006 and have received a refund please let me know in order for us to advise our lawyer.

The lawyer also advised occupation licences are expected to be issued in September 2007 so those of you waiting to complete it is now looking like you maybe able to stay in your apartments by Christmas.

We also applied for a refund after October 2006 and have been told the same by our Lawyer, i.e. that we will have to wait until the properties are handed over which hopefully will generate enough capital to pay for the refunds.

I wrote to my lawyer on the 12th of December 2006, to request a refund.

In February of 2007, I sent a power of attorney for the lawyers to act on my behalf.

In April 2007, I was sent a figure for the full refund of deposit plus interest, I had to agree this figure.

On the 29th of May my lawyers received the cheque and forwarded it to me.

Has anybody received any information in the last couple of months regarding there refunds ?

We are still waiting having been told refunds should start to come through once apartments are handed over, this should be in the next couple of months (fingers crossed).

Dear all

We have just chased our Lawyers for our refund on Aureus - we have been waiting since October 2006 so over a year - they told us then it could take about 1 year to 18 months.

This is the reply we have just received from them - we are going to keep emailing every month to keep nagging them - anyone else with up to date news please?  Here are quotes from our Lawyer received this week -

'As I have advised you in previous ocassions, it is the Judge who decides the order in which the refunds are done and not me and there is absolutely nothing I can do to change this.
I know that no completions have taken place yet (the Habitation License has not been issued) which means that the company still has no funds for refunds. I know that some refunds were made when the company had funds but they have not had funds for a while and no refunds aare being made now, in any case, it is the Judge who decides.
 
I have no idea when your refund will be made because, AGAIN, it is the Judge who decides but you have to be advised that for example I have four client whose refunds have to be made before yours because their cancellations were approved in a previous meeting with the Judge, which means that you are not in the first list of refunds.
 
As soon as I have news from the Judicial Administration regarding your refund, I will let you know.'
Is this the same sort of information you are receiving?

Hello to everybody.

it is a long time now without any post in the forum, I supposse that we are all waiting for...    refunds, or completion time, etc.

I have not a lawer but I spoke to the "actual developer" and they say that all the "papers" are issued by them. Now its is time for Administraion to solve the legal issues, La Linea Town Hall, Junta de Andalucia, judge, etc.

What I know is that they will give the refunds back "when they have money".

When the apartments are sold finally to the customer and they get some money.

When?

Nobody knows  2 months, 4, 6.

Another thing is that the area around has changed a lot. they are building more complexes around. Maybe some of you have visited the place.


a little joke: (for me it is very difficult to translate a joke into english)

some days ago I heard a conversation about computers and somebody said :     is that device "plug and play"?
and the other said :   no, it is "plug and pray".

I think that is what we can do:   PRAY
