First case won aug 2008, second case won jul 2014, third was court of appeal which we won in nov 2015 That was when the judge revoked the costs. We were informed end of july 2016 that our deposit was released by the courts, it was delayed due to the Sept holidys, deposit in our bank 5th of oct 2016

Hi all
Just heard today that the court has agreed to some money being released before the appeal has been decided. The bank has 20 days to release the money to the courts which will then be transferred to the lawyer and then to us. Twenty days from which date, I don't know.
Fees will be taken from the money before we receive it and if the appeal goes in our favour, the fees will be returned to us.
Once again we wait, not too long I hope.

At long last !!!!!
We've just received communication from our legal team in Spain that we have won our case against bank under law 57/68. Our trial was only last Thursday 06th October at Alicante. So an incredible quick decision by the judge who, I have to say did appear a little annoyed at the banks continued denial of responsibility.
However this legal process has taken over 4 years since our first meeting with GM Legal in Guardamar del Segura. The delays being down to the current court system being so slow and bank taking full advantage.
We wait return of our money into our bank account because the bank will certainly go down to appeal. ( another delay tactic) But they are not ever going to win. !!!
We are so happy to have achieved this result and it simply would not have come about without the very informed and professional application of Law 57/68 by Guadalupe and her team at GM legal.

Has anybody out there had their Court Case in Almeria and if so have had their deposit back and how long did it take from positive Judgement to money back?

Hi All
Jusr heard from our lawyer that the banks haven't returned our deposit within the allotted time so they are asking the court to freeze their accounts until it is paid.
Is this another delaying tactic? When will it all end!!

Is this contra to the rule of law a form of protectionism of the Banks, or perhaps delays in the administrative system, or the Bank just being obstructive? It would be helpful to know the detail so that where necessary this can be reported for monitoring purposes.
I hope this is not typical, i.e. a pattern of events developing?
Perhaps the legal team could confirm, so as to act as reassurance for those with ongoing claims?

Hi Briando
I think we have to assume that the money in their accounts can't be touched until we are paid our dues.
I think it's time the courts were declining all appeals and just making them pay back all concerned.
