Is it illegal to sell off plan property with no guarantees?

We have recieved a letter from "Promociones Murcia Y Almeria " informing us that blocks 6 and 7 will be finished shortly.  They are wanting to know if we are in a position for them to bring forward the dates for signing the registered deeds.  This has come as quite a surprise because we were told by our MRI Solicitor only last week that it would be approx February 2008.

Has anyone else recieved similar ? Also, has anyone got any knowledge of our legal rights regarding such an early completion?

                       it may be the developer is given you two months notice asin the payment procedure.

we are in block 5 and do not think it it will be till may .if it is ready they have to get alicence of first occupation,which means all

common areas should be safe ie.lifts walkways.

                

 

 

 

Hi, John here.

Just letting you know that we have been in touch with our spanish solicitor Violette today and she has explained that the early completion is an option that the developer is offering and not to worry, we can still complete in Feb 2008.

This has put our minds at ease as we hadn't anticipated such an early completion.

           i do not think with violette looking after you you will have to worry. we put down our money in march 05, it s  amatter

of switching off . we have been over 2 months ago  8 times so far they are not that fast,i think  march - may  5-6-7 .

if you look at photos they  cannot  finnish all blocks in feb some 700 apartments unless they get all builders in almeria.

it has taking  2 years now with show apartment opening 6months ago .

is it open now, was not 8weeks ago.

Hi aandi,  Thanks for that.  We too put our 30% deposit down for a 2 bed  penthouse in block 6 in oct 2005.  We've visited numerous times and have friends living out there who regulary update us. We now believe blocks 6and 7 are ready.  The developer is now contacting buyers to see if they are in a position to complete earlier.  Maybe they will concentrate on getting the interior of their apartments ready first.

Personally we dont want to complete yet and I would imagine that the builders will still be everywhere in those blocks.  Renting out the apartment would be difficult if that's the case.

 Has anyone heard if theres a choice of kitchens, tiles etc...?  We were told by the salesman from MRI that we'd be given a chioce of kitchen units but I've read that it is'nt the case anymore.

We have queried choice of kitchen colours and tiles with MRI and they have confirmed that there is no choice. 

We were also told when purchasing that there was and have expressed our concern.

        so the show apartment is open,  asit isin block 7 . we hope to go over in a few weeks.

Hi Everyone, I´m posting this reply from Hotel Almerimar just to give you an update. I have taken photos of each block and will post them up on my return. Block 7 is lookin very good as you will see from the photos. I have been in Proindal and have been assured that there is no choice of kitchen or tiles. The only difference is if you have 2 bathrooms your 2nd bathroom will be tiled differently. It is true block 6 and 7 are ahead of schedule but still expect it to be the new year until they can be habitated....licences etc. The show flat is not ready and will not be for another few weeks. I think someone mentioned it is in Block 7, this is not the case. It is in Block 1,,which makes sense as block 7 will have residents in the new year. The delay is due to a safety and access situation on the site, the apartment is ready to go. I have noticed more restaurants and bars and a general lively feeling to the place this year, no doubt Porto fino is the best location in town. Derek
