Dear all

It is my understanding that a new building regulation came into force in September 2006 stating that Rejas (window grills) should be fitted by the developers/builders to all ground floor windows on new build properties completed after this date (at no extra charge). This includes ground floor apartments.

Looking at the recent photos of phase 3, this is not happening.

I have been in touch with my agent who is following this up with the developer, Costa Blanca Balearics, who initially told me that they would be fitted. Failing this I will be instructing my solicitor to take this up on my behalf.

Can anyone else buying a ground floor apartment on phase 3 contact their agent and/or solicitor to press the developer as well please?

The more buyers that cntact the developer the better chance we have of getting this done.

Hi Brian

Have contacted our agent to chase up.

My mother in law is returning from Spain today. Therefore, hopefully should have some new pictures for us within the next day or so. She advised that as far as the builders and the site manager are concerned the build is completely on schedule for end of June. It would be the 3 bedders at the end which ran over if they fell behind. Our agent (Medsea) has already made appointments for us in July to go the furniture shops, make will etc. They took me for my NIE number on my last visit last October and they have just opened our bank account for us. If your Solicitor has power of attorney they can sign any documentation in your absence anyway so I would not  worry too much and from what I can gather as long as it is ready they will give you the keys and let you move in before you have completed if all does not go to plan and the solicitor can finish off if you have to return home.

Thanks for that John & Caroline,

My agent has been back in touch, he says the developer is saying that rejas are not included in the specification.

In a sense this is correct as 2 phases of the development were completed before September 2006. However the regulation says that any development completed after this date must have rejas fitted.

I have now contacted my soliciitor to take this up with the developer directly.

Nothing ventured, nothing gained. Although I still feel the success of this will be pressure from a number of buyers, the developer will ignore one or two .

I received the following reply from my solicitor today

 "You can not ask for something that is not included in your contract or in your Qualities list.  After you sign the contract and give your consent to what you are buying, if you do want grills on the windows then its an extra charge which you sort out with the builder direct". 

It would appear that if your initial contract is signed after September 2006 rejas will be fitted to the ground floor windows on a new deveopment.

As we signed our contract in April 2006 we do not come under the new regulations. I was confusing completion with contract.

Apologies if I raised anyones hopes.
