hi all,
i was told when i bought my apartment at cortijo that there was a bankers/builders,
guarantee ,being a bit green at the time i just accepted it .
so i have never actually seen it in writing,has anyone else here actually seen it,
or knows whether there is one to cover us in case aifos go belly up?

Our lawyer says that we have a Banker's guarantee, as this was one of things we made sure when we signed our contract, one assumes all the contracts should be the same.
Do you have a copy of your contract? I believe you are going to see Rosa when you go out in July, she can have a look at your contract and advise you accordingly.

Our lawyer told us we have a guarantee too, which is why we did not try to get our deposits back some 18months ago. Hopefully we will be protected if Aifos do go belly up. Does anyone know if the lawyer would be liable if there isn't a guarantee?

Hi there - we were also told we have a bank guarantee by our abogado and also took this as the reassurance we needed to not pursue getting our money back before now, but now our patience has run out.
We are just trying to move our file from a poor abogado who I think is "in " with Aifos, to a firm recommended on the site - marbella solicitors.
I've only seen an english translation of someone else's Aifos contract - looking back I can't believe we acutally signed up to buy the property based on this but we were excited about our home in the sun and just accepted that all of the contracts would be the same, the abogado was also very convincing that everything was normal and above board.
The english translation of someone elses Aifos contract that I have refers to the Spanish law clause that madates the bank gaurantee. so this gives me a little confidence but I cannot be sure my actual contract is the same. So I'll let you know what our new solicitior says about the bank guarantee and our contract when we finally manage to get our file transferred from our current Abogado who isn't being very co-operative. Fingers crossed this will be soon.

hi we live in spain and put down deposit for a ground floor apartment we went to the site after being told by 2 lawers not 2 touch it people cant get a mortgage no licences never will be only cash buyers will be able to live there,we have been told were not gettin our money back by casablaca even though they have stopped building ther not aloud to carry on building we went to site and it was all shut up we got through fence and was shocked in the apartments it had woodchip on walls sprayed white the finish is awfull

yes dont ever use them u can never get n e wher the boss is never ther the vendor pulled out of oue property and casablanca still got r money very rude and we found out from people they keep it were never get it back

Dear All, I always feel like the angel of death when I write on this site as I only ever seem to have bad news.
From what I can ascertain Aifos are in financial trouble and I understand have laid off 50% of their staff. Something to do with liquidity issues caused by Malayan activities. This is apparently why there are no workers on site, because Aifos cannot pay them.
If you haven't already managed to get confirmationof your bank guarantee I would suggest that you do this at the very minimum. I've yet to get a satisfactory confirmation that we have this.
I'm just starting the proceedings of going to court to get our money back. Mainly because I'm expecting my first child and we need the money back to buy a bigger place here in the UK.
Forewarned is forearmed as they say - I don't want to panic anybody, but I would seek legel advice from your representatives about Aifos and its financial situation. So you can make informed decisions about how you proceed with a company that is in my opinion a bunch of crooks!

Just spoke to lawyer, no bank guarantee. I'm more angry at myself than him or the agent because I believed them when they told me that there was a guarantee and I should have had it confirmed from elsewhere, however, like a fool I trusted them to do the right and honest thing. Aifos now reap what they have sown with their underhand business activities and mugs like me will lose lots of money. If I can get an appointment I will go and talk to Rosa next week and see if anything is salvagable from this debacle but I fear the worst. I knew that Aifos had problems in other parts of Spain caused by cash flow problems and I wondered how long it would take before it was no longer sustainable. However, when you treat your clients like sh*t, pretty soon every prospective purchaser gets the message that you're bad news and bingo, you can't sell an apartment! I wonder what those idiots thought was going to happen! I just hope everybody else here has a guarantee.

If this is of any value. Around two years ago when I was at the site viewing from up on the hill an English guy drove a little past me then stopped and came over to have a chat he said he was an estate agent (isn't everyone?) and lived in one of the houses at the end of that road ,he said he had spoken to many English people viewing at Cortijo. He said at that time Aifos were forever moving their labour and subcontractors around different sites and how they were always replacing them as Aifos were short coming with their wages.
Now once again we have somebody else’s opinion its hard at times to know what to take on board.
My personal view (for what it may be worth) is this site will be finished and we will possibly all get our properties and maybe this is normal Spanish developers behaviour. Until somebody who has the true Knowledge advises me otherwise I will remain the optimist and see it through.
How YOU act is obviously entirely up to each individual but I will be stickiing it out.

Hi Andy, I don't have any alternative to sticking it out so that's what we'll do. However, this has turned into a disaster and whenever I search for information on the internet pertaining to Aifos, I never turn up good news, or even anything neutral. That company is an absolute disgrace and how it is permitted to continue trading is, quite frankly, mind-boggling. However, we'd better hope that it does because if it goes belly-up, so do I, at least for a while!

H i all,
After seeing all the doom and gloom posts on here yesterday I decided to ring the lawyer I use,
in fuengirola, now I don t know if my lawyer rosa is a different rosa to everyone else s but she ,
did nt know anything about all these latest reports ,she told me that nothing has changed since ,
I last called in to see her in july.
I think it s the same old story people hearing rumours and panicking .
as for the buyer who reckons he only lives a couple of yards away from cortijo,why has he left it,
this long to tell us?I m going out there on the 22nd of this month ,so I will get first hand information,
When I spoke to rosa this morning she said when I call in she will ring the town hall to ask the latest,
situation at cortijo.
oh and the lawyer I use is rosa corredas balmoral avda los boliches
