A friend visited the site last week and informed us since my last visit nothing had been done in Block 8.

I have asked for a breakdown of the charges on the rental programme and are listed below:

Cleaning £60.00

Key Holding £55.00 per month - At the start we were told that Ocean View were to have an office on site to pick the keys up.  Now they will be left at the Airport.  This means that you will have to queue up to collect your car and then queue up to collect the keys.  Knowing how long you can wait you could be at the Airport for sometime.

OPV will take commision between 10 to 25% of the rental

If the holiday maker goes for a week they get a car and guess who pays for that us £80.00 aprox

Then there is electricity used and guess what if the holiday maker leaves and they leave the air con on that will push up the bill.

I have worked out that we will be lucky to get £34 per week in the off season and £297 per week in high season.

Also in the small print Ocean View say that the rentals will only cover the interest payment, only just picked that one up.

With the above figures in mind we are pulling out of the Rental programme and furniture package as I have been talking to local providers.  Cleaning 12.00 Euros per hours They say 2 hour to clean the apartment.  Laundry 12 euro for a 8 kilo bag,  no charge for holding the keys.  They say that they will manage and supply the furniture and that includes air con to a required standard.

Ben from Ocean View first told us that our kitchen would be stripped out and replaced and then we were told no they will put in extra cupboards.  I can only see one location for the cupboard and that will be wall mounted at the far end,  so again you will not be able to reach it without a pair of steps (lets hope they are thrown in).  Like others I think the kitchens should be taken out and redesigned and before they are refited the design is sent out to ALL buyers to approve.

We are very happy with the apartment (except the kitchen) and our location.  We are very disappointed with the build time 4 years and reading other comments another year for snagging.  I would say there is little or no rental protential this year.  As we are pulling out of the funiture package has any one got their deposit back.

As there are quite a few of us in the same position regarding rental and management of our properties on Manilva Beach, what is to stop us getting together as a consortium, appointing a property manager/key holder etc, this way things would be a lot cheaper. I am as concerned as everybody else about this sorry business, these are our properties perhaps we should market them ourselves and reap the deserved rewards ourselves not pass more money to ovp to squander.

I agree Eltonia, I have just come back from a visit. I will be posting a separate article regarding the state of play with furniture.

Is everyone aware there are only 5 apartments been fitted out so far ? I was told by Stuart Jones that the reason they were not currently renting is that the phase 2 development needs to be completed before OVP / Expedia / Hoseasons etc... will allow the site to be rented out.

NOT TOTALLY TRUE! How can they rent phase 1 with only 5 apartments fitted out ? I was disgusted with what I saw. There has been no progress at all since Xmas.

Also, I need to discuss issues with OVP as currently we could not rent - no lights WHATSOEVER on the complex. Pitch black at night. Door entry system not fitted and wires hanging out everywhere at the gates, and..... get this one - 3-4 weeks waiting times for the curtains!

Have you got any way we could get something going for property management ? I tried Duquesa Estates and they were less expensive (prices as in the previous posters mail). But I think we can get cheaper than that.

I posted a leaflet through every single door asking people if anyone could do a management service. I got no replies - in the main because there was no-one there!  So 140 people out of about 150 apartments (roughly) have no furniture and their apartments are unused. What is going on there ?

Just to let you know I complained about the lack of curtains and they were fitted within a week!

If you do have any luck with finding someone locally who would be happy to key hold, do the cleaning and laundry please let me know!

I have an apartment in Block B on phase 1. I am meeting a local couple there in early July while I am fitting a brand new kitchen. Those who have been will know why !!! This couple are possibly interested in renting long term and keep themselves busy doing key holding and management for owners. I will ask them if they are interested in providing this service for others at these developments and then let people know via this forum.

Just wondering if the couple who bought an end appartment on phase 1 in 2003 through a guy called Jim are following this tread.  I have met you on a couple of occasions at Torquay  OVP office during the open days they had.  I cant remember your names and would like to get in contact as I dont know any other owners from the South West.  Send me a private mail if you like.

Buy-to-let Britons are learning a painful lesson from their investment in the holiday rentals market, says Hugh Ash

Already reeling from news that their properties' values are under threat, British homeowners in Spain are facing a double whammy that could plunge thousands into huge debt.

A fresh crackdown by Spanish tourism and tax authorities over unlicensed apartments and villas that are let to holidaymakers threatens to trap countless Britons, anxious to maximise their investment in homes on the Costas and the Balearic Islands.

The news comes two weeks after shares in major Spanish property companies slumped by up to 22 per cent - due to the oversupply of houses - and soon after the euro interest base rate's rise to 3.75 per cent, which has added to buyers' mortgage burden.

Many of the 300,000 British investors in Spain's overheated property market have already turned to the lucrative holiday rentals sector and many more are considering doing so to ease their mounting financial strain.

But, seduced by the prospect of netting £1,000 a week in high season for a two-bedroom flat with a sea view, few realise that they face swingeing fines of up to £20,000 (€30,000) because they are breaking tourism laws.

The expanding opportunities for buy-to-let investments, which generate income to repay mortgages, have acted as a hefty inducement in luring thousands of British people into snapping up properties in the Spanish sun.

However, the vast majority of flats and villas cannot be offered for holiday rental, because the tourism authorities do not license them. And, even if official permission is sought, it is rarely granted.

"There are strict conditions before properties are approved for rental to holidaymakers," says a spokesperson for the Spanish Ministry for Tourism. "Nearly all are not licensed, which means letting them to tourists is illegal."

Property owners also face action from the Spanish and British tax authorities, who have stepped up their scrutiny of holiday rental websites if they fail to declare income from lettings.

Already several British investors in Majorca, the second most popular holiday-home market after the Costa del Sol, have fallen foul of Spanish law.

Londoner Tania Osbourne is appealing against a £20,000 fine for letting out her £200,000, two-bedroom flat on a complex in a popular Majorca resort for holiday rentals, after a Spanish neighbour tipped off the tourism authorities.

Another British owner was recently fined £4,000 and ordered to withdraw his apartment from a holiday rentals website. And five others, who wanted to let their apartments to holidaymakers, have been threatened with legal action by neighbours.

Tania, 63, from St John's Wood, explains: "I wanted the flat as a buy-to-let investment and the developer's sales director told me it had excellent holiday rental potential of up to £800 a week in high season. So I bought it with a mortgage from a Spanish bank.

"After I'd completed the purchase early last year, I put the apartment on a holiday rentals website and was overwhelmed with inquiries from the UK. Very quickly it was booked solid for nine months.

"But I was suddenly called to a meeting with the head of the community residents' association. And he spelt it out in the bluntest terms that the development was unlicensed and we would be reported if we continued to offer our flats as holiday accommodation.

"We had no idea the development had to be authorised for tourism use and we were all relying on the lettings income to pay off our mortgages.

"I immediately pulled the apartment off the website and put it up for sale. But that didn't stop one vindictive neighbour from informing on me to the authorities. Now I've been hit by a £20,000 fine - far more than I ever made from the lettings - but I'm hoping to get it reduced on appeal."

Lawyer Sebastian Stalter, whose practice in Palma specialises in advising foreign clients about property purchases, warns: "The rules governing holiday rentals are particularly tough in the most popular tourism areas, like Majorca and the Costas.

"So British buyers must be extremely careful if they seek properties for buy-to-let investments, because the experience can be a painful one if they have not checked out the pitfalls in advance.

"Many developers don't give accurate information about what their properties can be used for and it's very rare that apartments are licensed for tourism."

Dont Know!! Just putting the question our there to find out because if they are not and there is someone to be 'fined' it wont be Ocean View, it will be down to individual owners!!

I am trying to contact OVP regarding something else, so I will ask them to provide me with that documentation.

If it is not licenced, then OVP and OVP Travel are likely to go bust very quickly I imagine, as their holiday rental business will become non existent overnight.

I'll wait for clarification from them though before I start paniking. The properties were sold to us specifically for rental / investment so I'm sure it will be fine, but I want written confirmation from them.

Any one else out there from birmingham area,west midlands who feel rather angry at the way we have

all been treated by OVP.We should all arrange to meet & discuss what to do about this as a group.

Is anyone in favor of this.please let us know via  this site,dont let these people walk over us any longer!!!!

I called Stuart Jones last week and he told me to email him the query and he would forward it on to OVP's lawyers who would answer it.

So, in short, OVP do not currently know.

In the meantime I'd pursue ABTA and I will pursue OVP too.

i'm not sure?, but it might be worth contacting the local town hall or whoever provides the license? Could be faster?. Have you tried a lawyer on the forum like maria? She's having a baby, so probably busy!. 

As OVP have marketed these places very much for rent potential, it seems strange that they would have to confirm their own rental advertising copy, by way of a lawyer??????????

Good Afternoon All, after reading your comments if I wasn't at work I'd be down the pub drowning my sorrows.  We have bought on Manilva Gardens& Estepona Beach & Country Club but have considered the idea of selling prior to completion. However I believe the value of 2 bed apartments in Manilva are not selling.  If anyone could give me an idea of what their bank valuation for a 2 bed 2 bath apartment was I could ensure that I have enough equity in it to furnish it and complete.  I am hoping it will be around Euros 300K. Other wise I am leaving work early for a large glass of red wine

I have been trying to sell my apartment on phase 1 at Manilva for 2 years and now I could probably get 150,000 euros if I am lucky. I haven't completed, nor do I intend to, but the buy price is 200,000 +tax

Thanks for the info on the amount your property is worth. However does anyone know what their 'bank valuation' for their Manilva Beach property is?  I am under the impression it is the 'bank valuation' that mortgage lenders will go on not estate agents valuations.  This is important for remortgaging the property for furniture packages and completion costs.
