Thanks for that Stephie, so it looks like the Pool will not be built at all, interesting that my Lawyer says they cannot get a definite answer from Ros Y Falcon, perhaps they're hoping no one will notice.

My solicitor has spoken to Ros y Falcon last week regarding the second swimming pool. They stated that the second swimming pool was approved by the local town hall but following this there was an objection from the coastal authorities who say it is too close to the sea! Ros y Falcom are continuing to appeal this decision and if it fails they have an idea to put the second pool in some land next to Block 2 - I do not know where. They also said if I wished to cancel the contract they would refund me 50% of what I have already paid. My solicitor did say the contract does allow for them to make modifications if they are imposed by a government body, but if we do not get a second pool we have a good case for some compensation.

Hi Melvin8ball it seems your solicitor and ours are getting different info. Ours has sent us plans of the swimming pool to the left of the developmenr facing the sea. He assured us that it is going ahead!!!! We are not happy . We will now have another go at him.

Hi all
Has anyone had any contact with the developer recently regarding completion of the apartments? I was in touch with the develper and they advised that everything was with the town hall for sign off and completion may begin in mid-August? Also is anyone having any difficulty with Banco Sabadell Atlantico, for the subrogation of the developers mortgage? We are finding the bank very slow and not forthcoming with information on the mortgage and what stage of the process we are at.
Have there been any more movements in relation to the swimming pool at the front of the development?

Hi All
My solicitor has been in touch to say the certificate of completion is ready for our apartment.
I also asked was it possible to view apartment before signing and yes - this can be done by making an appointment.
I have also been in touch with a Sr Gomez at Sabadellatlantico and I have found him to be very quick with his replies and info.
It appears the subrogation mortgage has a number of advantages and will cost us around 0.2% commission. It does mean taking out the life policy and apt insurance with them though. At this moment It appears there are no other bank or arrangement fees to pay.
My solicitor tells me we can save the 1% stamp duty which in our case is close to €3000 if we take the subrogation mortgage. The rate is 0.75% above euribor and can be for up to twenty years or 75 years of age. Please bear in mind I have requested and received most of this info today by email and have not, as yet ,confirmed it in a follow up phone call.

Thanks very much for the info. , you seem to be a lot more informed than us. I think I'll be calling our lawyer on Monday to get some answers. The person we were dealing with at Sabadell Atlantico is on holidays for the next two weeks but Snr Gomez must be picking up her emails as he got in touch with me through the week. We are still no further though as to knowing if the mortgage is in place and we are just then waiting on the legals. We called in with the bank at the beginning of February and still nothing appears to have been done with regard our mortgage application.
I didn't know anything about the saving on stamp duty by taking the developer's mortgage, thank-you for that info.
If you hear anything else, please keep us informed.

Hi All
I spoke with Maria at Ros y falcon last Thursday 17th July. She said she expected to have the certifcate of habitation by mid August. It cant be completed before this is issued.

Hi Kel
i contacted Ros y Falcon to see if I could view apartment before completion. They said they would do the snagging but I could see the apartment if I wished. Unfortunately, I cant go over now at this time. A friend of mine is looking for an apartment and is going to call to Ros y Falcon to see whats available. I will keep forum updated if he comes back with any news.

In answer to Kel Last time we went into the office we asked for a price list of the properties available,I could not help but notice some of the prices (not all) were less than before.
We were also assured the swimming pool was going in the front but the whole frontage is now landscaped.
We were also told that the main swimmimg pool is not suitable for children that may please some people !!!
We will be in Spain as from tomorrow ,our other property is half an hour away, and we will be keeping a close eye on the situation.

It would be great of any up date. Still waiting for feedback from lawyers who are in contact with the developer with regards less square footage than original plan!!!
It just seems strange to say they plan on putting in front pool if they've landscaped it already.

I was there last week.
Basically there is definitely no second pool. I believe this is a major issue as the pool that is there is extremely deep and totally unsuitable for any child who is not an able swimmer. I am taking this up with my lawyer, as this appears to me to be a fundamental change in the contract, not a little change that they can get away with.
The development is complete, it does need a good clean, Ros y Falcon are saying that the will be ready to handover "anytime", I think they mean weeks not months.
They said that we have 30 days after completion to snag.
One other issue for me is that as part of the development the promenade outside was to be continued and finished by Ros y Falcon. They are saying they are waiting for "permission" for this and it may take 2 years to resolve! If you have a beachfront view apartment it will be very interesting as to where the weekend beach visitors park their cars, as at present it becomes a car park in front of the development. I must say this sounds suspicious to me.
Sorry to appear negative, but what I would say is that once you are inside your apartment the quality is outstanding.
