We are one of the buyers represented by Patricia.
Patricia is acting for 3 different buyer groups.
1 - Those on phase 1 who wish to recover their deposits - either because they thought they could make money by investing in 2 or more houses and selling contracts and now cannot and so are faced with 2 or more mortgages , or whose house is not in the same style i.e no longer detached, or those whose house is the same style but no room for a garage etc.
2) Phase 2 buyers - nuff said
3) Those on phase 1 who still believe that they can complete on the house even if they have to pay the extras
Patrica is acting diligently for all of these groups and will ensure that before completing on any of the houses that it will be legal.
As mentioned in a previous post - the houses are worth more even if we have to pay extra for them.
Even if it becomes impossible to complete due to lack of habitation license up Patricia could still instigate more criminal proceedings to recover the intial investments of those still unable to complete.
The fact that Palmera completions will not act any more to complete for the buyers is a breach of contract by Palmera and they have to find another solicitor to complete for those buyers who still wish to use them.
We decided last year to engage Patricia to complete for us so we could be sure when we complete it was totally legal and unbiased .
So it is not necessary or impossible to complete without the Palmera solicitor.
One final thing - some of us seem to be getting paranoid about all this and scaremongering - I hope this is a more balanced view .
