So what is the answer? They claim to have no money.
I see no positive conclusion at all.

I agree, based on the last posting , if they have no money!
I e-mailed my solicitor again after the last posting and forwarded the posting to him.
He can back and confirmed that Mirador are not going to pay the taxes, but they are in negotion with the tax office and I have pasted my solicitors reply:

In accordance with the tax office responsible who spoke to us, Mirador is not goin to pay the money owed, but they are doing is negotiating with the tax office two options:
 
a) Transfer the embargo to another Mirador´s assets (land, industrial soil...etc)
b) That the tax office cancell the embargo before the Land Registry against an agreement with the company in order to cancell the debts after the handing over of the properties.

Personally my Husband and I are going to wait and see and give it another month i really don't see what other option we have, crikey we've waited 7 years now and the money we paid was 7 years ago , if we sue, and according to some peoples reports Mirador have no money, so what would  we be sueing for?


I may be too naive - but I don't see who wins if the apartments are not released - if the tax office lift the embargo in some way, then the apartments can be released, Mirador get there money and then they can pay their taxes - funegirola town hall then don't have a complex that stands empty , and we all get what we paid for - am I being naive ?

The answer to any question about promoters like Mirador and Aifos is always the same: to take them to Court. Unless you have checked carefully the legal situation of the house, and you have found out every details is right, if the building works are late, the money paid is not guaranteed, you have not a clear hand over date in your contract, you are forced to pay all deeds expenses and plusvalía and other abusing conditions... the answer is always the Court. I do not mean the Court is fast and perfect, I only mean that dealing and trying an agreement is a total and complete waste of time, that is, of course, what they want you to do. 


One short note: some of you have sent to me private messages. I am sorry, I would like to answer you but I am not able even to read your messages as Eye on Spain private message facility does not permit me. I have asked for permission but I am still waiting for it.

Evening everyone,

We have just retunrned from a holiday to find a e-mail from our solicitor saying that Mirador have had the final building licence granted for blocks 5,6 & 7 and want to start handing over the apartments in September -- this year !!!
Has anyone else heard this ?

No we have not heard anything.  In fact we have been told that some of the apartments have been seized by the Tax Office as Mirador has not paid taxes.  It just goes on and on and on.........  If you hear anything else please keep us posted.

Morning all,

Quick update:
Our solicitor has requested  financial information so that our mortgage can be completed.
We have also received a letter from Mirador this morning, a copy of which I have scanned to our solicitor as it is in spanish.

As soon as I have the translation I will let you know - should anyone want a copy of the letter I am quite happy to send it to you on a private basis.

I've got a very basic translation off the internet , so apologises for the wording , but I think it gives us an idea of what the letter says:

HAVE OBTAINED THE FINAL CERTIFICATE OF WORK PERTAINING TO THE BLOCKS 5.6 AND 7 OF THE SECOND PHASE OF OUR PROMOCION CALLED TORREBLANCE OF SUN, being PROCEEDED, LIKEWISE, TO THE REQUEST OF THE CORRESPONDING LICENSE OF FIRST OCCUPACION

BECAUSE OF IT, AND SEGUN OUR CONTRACT, IN ORDER TO PRCEDER TO IT PUT TO DISPOSICION OF THE DWELLING, we BEG be PUT IN CONTACT WITH OUR DEPARTMENTO OF ADMINISTRATION COMMERCIAL IN THE SCHEDULE OF ATENCION TO THE CLIENT INDICATED TO THE FOOT OF THIS WRITING IN ORDER TO INITIATING DEAL WITH THEM MANDATORY AND PREPARER THE DOCUMENTACION NECESSARY AND REQUIRED BY THE FINANCIAL COMPANIES FOR THE SUBROGACION MORTGAGE

Glad to hear something is happening with habitation for blocks 5-6-7,hope everything goes smoothly,its been a long wait.We are block 9,anyone heard any news?Would like to know if anyone purchased via Palmera,with a contract with Mr Malou,rather than the builders,on blocks 5-6-7.

There are others with Mr Malou (including me), who I think is North African, but I don't know how many. Probably most of the latter blocks.
With regards to blocks 5, 6 & 7, I would urge people not to get too excited. I put the facts to the CDSAG lawyers. They are encouraged that at least there is an attempt to move forward, but they checked the status of the development, and have confirmed there is still an embargo on the land, and there has been no application for FLO. They doubt there is money to go ahead, but let's hope.
If they do go forward it may be at the cost of the likes of you and me Alan, as I'm in block 10. Perhaps they will sacrifice the last 3 blocks to the taxman as a compromise?

Dear All,

Just to give you an update on my last posting.
My solicitor has confirmed that the FOL has not yet been applied for, they are expecting this to be granted within the next few months.
With regards the embargo, Mirador evidently have arranged with the tax office, that on the day of signing at the notary, a representative will be there from the tax office and they will take a portion of the sale price to go towards meeting the debt, the embargo is then lifted off of that particular apartment.

Hope this helps - I think it is a positive step forward but we will just have to wait and see - I'll keep you all posted as and when we hear more.

Good luck with it and I hope it really comes off. Block 10 still sounds (and looked, in June) a long way off. Maybe I should be a bit more optimistic, but after over 5 years...................

Hello everyone, I have been watching this and been in touch with lawyers who said 2 months ago, i would probably loose all my money. They said no one had any money and that we would spend bad money after bad to chase them through the courts.
Iunderstood there wa a tax embargo but that the licencehad been taken back and they could not afford to get another licence and the town hall did not wish to grant another licence.
Maybe I am gettingsome things wrong but I got most of this from lawyers.
My propety was from Mr malou or whatever his name is. I also heard as he got paid the money from mirador they have no say in the properties sold via him, so therefore
Grup Mirador dont need to complete on these as they may not get any profit. 
If someone can hlp me get to the bare bones it would be great to hear from anyone.
