HI All
I have an updaded list of the owners who have outstanding charges
i asked marinsa sol to take anyone to court who had outstanding debts of more than 4months of community charges , this was back in november of last year . They have dissregarded my request untill this last week
I now find out we can only take these owners to court for the ammount they owed at the last meeting
below is the e-mail i received tonight
I would like you owners to ask Marina sol to resign so we may appoint a company that will do what We want them to do
the choice is yours


About the debtors:

You can see two list attached.

1. The updated list until today (Listado deudores 27.03.0icon_cool.gif.

2. The list of the debtors at the last meeting (morosos Hill meeting).

As you can compare with the two list, some of the owners had paid and others not.

The problem is that to take legal action we can only claim for the amount that was approved at the meeting, because if you go to court you need to present the minutes of the meeting where were approved to take the legal actions and the amount valid is the one that is attached in the minutes.

This is a legal requirement, because if you tried to claim for more money, the process is going to be rejected.

After that, I think that the properties that we should start the legal process are:

Viv. 1.0.10 Trevor Morley (1.017,87 €uros)

Viv. 3.0.03 Maria Cristina (867,87 €uros)

Viv. 4.1.20 Rosemary Martin (631,41 €uros)

Viv. 5.0.02 Peter David Wright (1.017,87 €uros)

Viv. 5.0.07 George Albert Slye ( I think we should wait for it, because I have been in contact with them: see the emails attached)

Viv. 5.2.23 Equity Residencial S.A (904,10 €uros)

Viv. 6.0.02 Manuel Luis Sanchez ( 939,14 €uros)

As you have now all the information, please check it during the weekend at let me know your comments.

I have explain all to Paqui and as soon I have your comments we will start the legal process next week.

Soy un residente de Andalus Hill y yo he sido muy infeliz con su servicio como el adminstrators de comunidad.

Es mi vista que su compañía no representa buen valor para nuetro dinero y que sus servicios son de calidad inferior, esto a pesar de varias advertencias de nuestro Presidente Sr. David Baxter que ha dado usted oportunidad amplia mejorar sus estándares.

Es mi deseo que usted renuncía en el acto de su posición como los administradores designados de nuestro communidad.

Sostengo Sr. Baxter en la cita de nuevo adminstrators y pediría que usted respete los deseos de la mayoría de los residentes, quién no quiere que Marinasol trabaje mas para la comunidad,

Sométase por favor su resignación tan pronto como posible.

Roughly translated:

Dear Marinasol,

I am a resident of Andalus Hill and I have been very unhappy with your service as the community adminstrators.

It is my view that your company does not represent good value for money and that your services are sub-standard, this despite a number of warnings from our President Mr. David Baxter who has given you ample opportunity to improve your standards.

It is my wish that you resign forthwith from your position as the appointed administrators of Andalus Hill.

I support Mr. Baxter in the appointment of new adminstrators and would ask you to respect the wishes of the majority of residents at Andalus Hill who do not want Marinasol to work for the community.

Your resignation is required.

Hi All
Having just got back from a meeting with Marina Sol
The update is
Within 5 days the soicitor will have the information to take 5 owners to court and will do that very quickly after that
These owners owe around 7000 euros between them
Four more owners are being sent letters giving them 15 days to pay
These owners owe around 2600 euros between them i have told Marinasol to take these owners to court after the 15 days
Eight owners are being sent a letter asking them to get there payments up to date
These owners owe around 2000 euros
that totals up to around 11600 euros
There is a further 1600 euros outstanding ,but most of this amount is from some owners paying at the end of the month and the numbers above closing at the start of the month
Some of you owners who owe money will read this if you do not pay your community charges you will be taken to court as the majority of owners who do pay are having to subsidise your non payment yet you still continue to use the facilites and rent your property out
