I visited the site in April, there isn't  much progress. Ive uploaded a photo of the site.

Does anybody know if they have started to build yet?

I was down in San Cayetano yesterday.

Phase 2 has not been started.

Talking to the women in the office she said that they had approval for urbanisation but were still waiting for planning permission to build. She said this would be in 10 days time.

They take everybodys´ deposit and have not got permission to build.

On past form I suspect it will be longer than that.

Taray is making a tidy profit on our deposit without doing anything.  Our pound was pretty strong last year, but sitting on thousands of euros and living off the interest from us is pretty clever but yet deceitful especially when they are still in the process of applying for planning etc.  I was told that my off plan in phase 2 will be completed in june 2009 (bull***t) due to having a baby this year i was unable to complete this year march so i had to transfer my deposit.  Having said that mazana 5 is no where near completed.

We also were told june 2009 but because of the shut down on august we would complete in september 2009.  We want to move in, in the september but it isn't looking likley.

Will we be intitled to compensation if they are not ready.

I am in the process of finding out.  I have contacted my solicitor (aldeas) but not reply as yet.  I have also emailed Maria de Castron, she has sent me some info and forms to fill in.  From my understanding construction in Spain normally shut down in August due to holidays and extreme high temperature. will let you once i've established what my position is.  since phase 1 isn't going to have a pool built I doubt if we are going to have one built either.

hi just a note of caution to all you in phase 2, as you are all aware by now it seems that we have no pool in phase 1 despite all the promises from toray etc i would be very careful before i parted with any money on phase two until i had it confirmed what and when you are getting.

we are now in a position in phase one where toray told us we would have a pool when we were signing, then it was the pool was being built when all the units were completed due to dirt etc now its the town council are building the pool if and when they feel like it.

i would not accept toray's word on this also we were told that toray will not be allowed to start phase 2 until all units are sold in phase one this is why they were offering some really great deals to anybody if they knew of anyone who was looking to purchase.

I was told when looking at property on phase 1 that the pool would be part of the community and the residence would pay for this on a pay as you go bases.

The pool on phase 2 will be tied in with the annual charges, but one never knows what will happen we will have to wait and see but will not complete unless the pool is built on phase 2

Bev is correct. We were looking at phase 1 in Jan 2007, but decided to hold off until phase 2 was released. It was clear to us from Taray that the pool on phase 1 was always going to be a communial pool owned by the town and that phase 1 owners could pay as you go, or more likely there would be a method of paying monthly/annually. This of course would mean lower community charges to owners on phase 1, as the upkeep of the pool etc would be the responsibility of the town.

The difference on phase 2 is that it will have its own private pool and the upkeep would be out of the community fees we owners will pay.

yeah its being made clear now but in april 2006 when we were looking at phase 1 it was not being said to you that it was a communal pool it was put to you like this.

the pool will be finished when your phase is finished, due to the planning regulations we have to make the pool available for use to thie locals from the town but this will cut down the amount you have to pay per year in relation to the up keep of the pool.

it was said to us that toray was building the pool but it would not be a fully private one due to planning regulations but it was made clear to us that it would belong to the residents of the development and they would have to pay yearly upkeep fees etc.
its very interesting to hear that you were being told in 2007 that it was a communal pool that charges would be applied on when you use it.

if you look at the development plan you will see what i mean

Teresa emailed on Thursday 19 June saying the had received the urbanisation licence and in 7 days they obtaining the property building licence and will then start.

On Tuesday 17 June my solicitor emailed saying Taray had informed them that they have received from the Town Hall the urbanisation licence in order to connect basic supplies for the complex ie water, electric.

Something is slowly happening but until we see it with our own eyes I dont think we can be sure of anything from Taray. Once Taray do start building then an approx completion dates should be available. We have already spoke to our solicitor about compensation but he thinks we should start 3-4 months after Feb 2009. That is our contract completion date. I disagree - I think now is the time to be telling Taray we want compensation due to excessive delays. I have a feeling Taray would just drag it on until the properties are ready and tell us to complete or lose our money.

What does every one else think about the timing of demanding compensation?

I forgot to mention Taray have 24 months from start of building works to complete and hand over the property. So realistically we are looking at September 2010 - not a nice thought. I suppose that is why we have a Bank Guarantee.
Has any one used a Bank Guarantee against Taray?
I wonder if Taray would do things different if many people threaten or started to use the Bank Guarantee.

Hi Colin

We put down our deposit in June last year and for the last 6 months now I've been checking my progress report through the MASA website in the hope that some work has been started, it is always blank. I also check EOS on a daily basis to see if there is any news but all I see is doom and gloom and let's have a go at Taray for one thing or another and ending up wishing I hadn't logged on.

I think what we have to remember is that we were told that completion would be mid '09, give or take a few months, so I think it's a bit early to be thinking about action against Taray just yet.

I would love to think that it would be ready for next summer so that we could have a holiday there, but it's not going to happen so at least we can make alternate arrangements and plan for 2010, by which time the exchange rate might have recovered, flights might be cheap again and the pool in phase 1 might be complete.

May be a little too optimistic.

Dear all
Taray has collected a lot of money 30% of the purchase price,  We could be earning alot  OF INTEREST on our money, £42,000 + from my remoetgage,in 2006 thats a good amount.  If the property complete 2 years later that is thousands of interest gained from taray.  That is enough to build a dam swimming pool with our money.

Hi Alan

I put down my deposit in March last year with a contract completion date of 28 February 2009. For Taray to achieve that date they would have had to start building in October last year. Taray will be in breach of contract by not delivering the property within a few months of February 2009. There was 6 other people who had put down deposits at that time with a completion of Feb 2009, I would be interested in their view point if they are on this site. I have been habitually lied to since October 2007 by Taray.

I accept a few months delay is normal but Taray will be 1 year late on my contract and I believe compensation is only correct. Taray have 92000 euros of my money, as a minimum I will seek lawful interest on that money (6% I think - 5500 euros). My worry is that by not pursuing Taray until next year, they will just drag their feet until the property is ready and then say complete or lose your deposit.
Every one can either sit tight ,do nothing and hope it will get better or be proactive and make things happen. Taray hopes it is the former.

I hope this explains my attitude towards Taray.

thought people would like to know that they have been working on phase 2 site today.  The path from the village across the site to the school has now been closed and the diggers have been flattening and creating  "roads"

GOOD NEWS 

Teresa from Taray email me today with the licencia de obras. dated 24 July 2008
This finally allows Taray to start building the properties and the pool in phase 2. With the roads and utilities starting couple of weeks ago, thing are now looking up for phase 2. We should be able to get a good estimate of completion dates very soon.

YIPEEEEE

Perhaps some good news about the pool and facilities at phase 1 might happen soon as well.
One good thing about Taray is they have not started to build without the correct licences in place. Many builders have built unlicensed properties and buyers have ended up being totally shafted. I have severly criticised Taray in the past but on this point they have acted correctly.

If any one on site can take photos of actual activity on phase 2, it would be appreciated.

I have posted a couple of photos of machines working on the Phase 2 site on 16 July, apologies for the cloudy skies but it did rain that morning.

We also observed, that rare species called 'Surveyors'. They were stalking round the site marking out their territory with pegs and yellow markers. 

At least something is happening now.
