IVA and Bank Guarantee Refunds

 I recently won my case against Banco Pastor (thanks Maria and co) and believe we should be entitled to receive a refund  of tax paid.

Can anyone advise me of what actually happens? I'm wondering if I need to go now to the developer to claim the funds (I think 5565 euros is a lot to pay for nothing - especially as it was paid 'up front' with no interest).

I haven't had a car for so long I feel that the IVA refund alone would enable me to buy a second hand run around. I'm looking forward to closing this particular chapter of my life - I think I've been through enough the past 8 years.!

My bank guarantee was only for the capital, so no IVA was refunded....I cannot afford to just let this go. Do I approach the bank or the director of Sol Mijas Developers SL?

As someone who wasn't used to property transactions in Spain I trusted the Andalucian Dream Homes associated lawyers to work for me, but apparently this was not the case.

All amounts paid ( including VAT portion) plus legal interests are BY LAW covered by those guarantees. Irrespectively of what the developer/ Bank granted to you.
