It appears that stricter enforcement methods (EU rules) will be made to ensure all properties over 50 years old have a current Inspección Técnica de Edificios (ITE) certificate before the property can be legally sold as very few owners bothered with it.
The ‘Property MOT’ must now be undertaken every five years as opposed to the old ten year rule and failure to do so will result in fines ranging from €1,000 - €6,000. If remedial works are required as a result of a survey and are not undertaken, the consequences can be as severe as revoking the habitation license!
The saving grace here is that it only applies to towns and areas with a population in excess of 25,000 inhabitants.

Please can Mario De Castro comment on this Law which came into effect in 2012 and does it apply to the whole of Spain. I read somewhere recently, that once buildings get to be 45 Years old,then these Technical Inspections have to be carried out automatically.

From June 2013, residential property owners of flats may be required by the competent authority, to prove the situation in which those are in relation to the condition of the building and compliance with current legislation on maintenance/conservation, universal accessibility as well as the level of energy efficiency .
After the report, works might become mandatory.
These reports can be requested with a minimum periodicity of 10 years.
Breach of this obligation is a Planning infraction with its corresponding sanction
