Community with a tourist license

Hi, we live in a complex which has a tourist license an about 2/3 of the apartments are owned by the tourist company. 

We are being asked as a community to pay for the extra items such as a Swimming pool guard and international tv (required for the tourists as most private owners have installed their own systems).  Are  legally obliged to contribute to these items or should the tourist company pay?

Has anyone else encountered these problems?

Swimming pool guard. This should be paid for by all members on the community, not just the holiday home owners. It is a legal requirement if your pool (s) area is over a certain size.

TV. I assume satellite. Check your initial agreement and deeds. If it is on there that is part of the community fees then you will have to pay. If it has been installed at a later date then only those signing up to the TV system should pay.

We have to pay for lifeguards but close one of the pools except for July to first week in September so we only have to pay for them during that period. Sat TV was installed but does not meet the needs of those who live here full time. However, it was on the initial deeds that it would be provided therefore it's built into the community charge.

Not all regions of Spain have the lifeguard regulation in place. Murcia for example does not.

You are in an irregular situation as all units in that complex should be under the tourist regime. It was a fraud used by many developers-banks, with the acquiescence of Local Councils during the real estate- financial year and of course with no information/ acceptance by buyers..

I would try to obtain  the  registration of this situation at tha Land Registry so you can never be imposed to charge with the burdens that you were not aware of when you bought. Noy an easy process. From a pure legal point of view you are residential units breaching the obligations that this classification brings to you
