Debt Attachment
The Comments |
I understand that if a Building requires repairs and the majority of owners agree then the cost is apportioned based on your quota. It would also seem that if some owners refuse to pay then other owners would have to cover the cost and then sue the none payers with any monies recovered divided according to quota to those that did pay. My question is unlike none payment of community fees which are time limited can these monies be attached to the property indefinitely until payment of the debt is made. Any pertinent information would be appreciated

If the property is part of a Community who have agreed the repair costs, the yes just like unpaid Community Fees, a Monitorio process can be commenced to claim unpaid costs and eventually a charge can be placed against the property IF no other assets are recovered.
