Help please, Witness to a Crime with Force

Can anyone advise us on what to do next please. My husband has recieved a summons to appear in Murcia court in January as he is apparently a witness to a Crime committed with force. The only problems is my husband has no idea when or where this crime took place that he has witnessed. Almoradi guardia tracked my husband down but the address on the summons is our old address in Algorfa and we havnt lived there for over 4 years. We have tried to phone the court to find out more details but they will only say they can not give us any information but if he does not attend he will be fined up to 5000 euros.
Is there anyway at all to find out any information ?

Hi Mazz, how awful. I really think the best way is to see a solicitor. It won't necessarily cost you a lot just for a consultation and trying to find your way through a legal Spanish maze will probably put you in the looney bin. It is hard to believe that they cannot give you any information at the court but a solicitor should be able to find something out. If you do end up having to go to court you will DEFINITELY need one anyway.

Your husban needs to attend that hearing obligatorily according to provisions 410 and ss of the Criminal Procedure Act. Of course he will be testifying on the truth acording to his own witnessing and if he has seen nothing..... he has seen nothing.

Thanks for your replies, it looks like he will just have to attend . It would be nice to know at least what it is hes meant to have seen, but never mind we will just have to wait until January.

What a waste of time for everyone, could result in case delays and all sorts ! Why isn´t there as process for this and why are you still listed as being at the old address? Isn´t this a catastro error issue?
