Signature on documents
The Comments |
We have been offered an increase in the length of the mortgage term on our apartment in Spain.
The idea behind this is to try to reduce the monthly payments. We have been told by the bank that we both need to sign the documents in Spain in the presence of a notary.
This would involve the expense of the visit to spain and the fees for the solicitor. Is there another way to get the documents signed in to avoid both of us travelling over to Spain.

Power of attorney is about the only other way. Did you give your solicitor this authority when you purchased, if so, is it still valid? It is about £100 in the UK for having the documents notarised, plus gaining the Hague Apostille, then whatever your solicitor may charge. It may well be cheaper to get some cheap flights!!

A proper and specific Power of Attorney for your solicitor will suffice. It needs to have the faculty of signing Mortgage Novation deeds.
