Spanish inheritance tax paid by UK citizens
The Comments |
does anyone know about owning a Spanish residential property within a UK limited company?
My accountants have informed me that if you put the Spanish property into a UK company you will avoid paying Spanish interitance tax. As the Spanish inheritance tax is against the indivdual it takes account of no NIL rate bands, as in the UK. If it is within a UK company, it will be included as part of one's estate in the UK and the nil rate band for UK inheritance tas will apply - hence the benefit of the first £xxx being devoid of Inheritance tax.
In addition, by doing this you also avoid the 'notional' tax applied to properties in Spain held by peopel lioving in the UK.
Has anyone come across this or had similar advice?

I too would like to hear from someone who has set up a limited company to avoid Spanish inheritance taxes. Particularly from some one who has probated an estate using this system and done it successfully. John
