We sold our house at a loss in 2015 but had to pay the 3% retention because although we had lived in Spain for 10 years we were not classed as fiscal residents. The solicitor said we were entitled to reclaim the 3% back and filed a return for us. Is there a time limit on the Hacienda returning the 3% to us or can this take as long as they want? I was told by the solicitor that it had to be returned by a specific date but now the solicitor is saying that it can be returned when the Hacienda decide. Is there a specific law relating to this? Many thanks.
