Hi All,

I am looking for a surveyor as I was over at the start of the month and in the internal specs to designed was almost to the letter right!  However when my friend and I measured the balcony it was about 7m2 too small.   Unless they included the wall and the flower beds on my balcony its no where near it.  I got word back they their designers have said its correct so want to get the balcony measured.  Has anyone hired a surveyor or could recommend one in Almierimar?

Hi,

I have a suggestion of someone who is not a surveyor but he has been involved with large scale developments for many years in the UK before he moved to Spain. It is Alan Sly from Alcor Properties.

I know at least one other person in Almerimar who is employing Alan to handle the snagging on their apartment in Porto Fino and I know that they discussed getting Alan to do independent measurement of the size of the terrace to check whether it is to specification or not..

John,

As per Pm I think that Alan is Sam Jones dad and they will be a conflict of interests about the whole thing.  Are there any other recommedations from anyone else out there whos done the same?

Hi,

I know that Alan is Sam´s dad but I can tell you for certain that there is no conflict of interest.

I already know from Alan that Sam knows that Alan is going to measure the terrace very closely on the property he is snagging and Sam is very aware that she will have to deal with the situation if the terrace is not right.

Guys,

Got a phone call from the developers to say that in spain the balcony includes the wall as well as the floor?  Can anyone confirm this please?

Hi,

Just spoken to Alan at Alcor Properties about this issue. He made two comments:

1. It depends on what is written in your contract so it is worth checking the contract you signed. (I guess this may mean getting someone to check it for you if necessary if it is in Spanish and you can´t understand it.).

2. According to Alan, whenever a developer knows that the terrace is smaller than it should be they normally try to argue that you should measure to the centre of the walls. Alan doesn´t agree with this if it isn´t in the contract and says that it is a position they adopt if they know the terrace is too small.

No problem.

Also, I´m not certain that this still happens but I think that Alcor Properties used to have a deal with a local solicitor where he came into their office once a week and gave out some initial legal advice for free.

It might be worth emailing Alcor Properties to check whether this is still the case as perhaps you might be able to get some initial free legal advice when you are next over.

I can´t guarantee that this deal still happens but it can´t hurt for you to ask.

Most contracts have a plan attached..if not then you should have had one otherwise you do not know what you are buying

All plans are of course drawn to a scale....it varies but may be 1:100, 1;50 1:75

So measure to inside wall and outside wall off plan and on site....give or take a tollerance there should not be much difference...check your plans

I have had an approach to measure the apartments by one of the buyers but to get involved there has to be  a group problem 

Now if the marketing brochure states size and the plans are different..even if you have not checked the plans with your contract you may have an complaint

......in UK it is very much 'buyer beware' but in Spain I am told [ and this would need legal checking] that if the brochure says ' a certain size' and it is not built to that size, then you may have an 'complaint against the builder'
