Hi all,

Going over in July to snag our property on phase 3.  I was just wondering if anyone could recommend someone locally.  Like a few others i'm having trouble renewing the bank guarantee.  Hopefully we are all safe at this stage.

At last the end is in sight..

Hi Danger,

We registered our home (Plot 7 Phase I) yesterday in San Pedro del Pinatar notary office, at least.

We´ve decided to register before the habitation licence because we wouñd like to spend the summer holiday there and we need one month to buy furnitures, lamps, etc...

The only problem we´ve found in the visit is that the white good wasn´t  installed, Yolanda told us they need to installed before registering the property, may be today or tomorrow. I´ll check it by phone.

The quality of the house was according to our expectation, quite good, we found several failures mainly in painting.

Swimming pool is not finished yet but I think in two weeks the commun areas will be finished, there was a lot of people working in the site.

We stayed at Hotel Playa Terreros , a smal new hotel very close to the site and two hundred meters away from the beach. Nice stay.

I would refer anybody contemplating to paying in full and signing at the Notary prior to getting the habitation licence to be very fool hardy!! It is not advisable to take heed of ' Eusebios  ' plan to sign now and worry about it later. I was at San Juan yesterday and Phases 1-3 are nowhere near ready. Habitation licences are issued by the Town Hall to confirm that a property is habitable! Any solicitor acting on behalf of their clients best interest will not advice this and also no Bank in Spain will release funds for a mortgage until this licence is in place. There are further threads on this issue. 
Also it is common practice either in the UK or Spain for a retention of monies to be held back until all facilities are finished off otherwise there is no incentive for the builders for the final touches to be laid to the site. Other buyes at CDP are now being told that sinks and shower fittings are not included!  this needs further investigation by all buyers.  Caveat Emptor "Let the buyer beware"

Can you elaborate a little more on the fixtures and fittings please as i am sure you will have a lot of worried people reading your comments as this is a major issue. I am with you all the way on signing for your property without licence, can not see why you would want to but there are a lot of frustrated and fed up people.

With reference to sinks & shower fixings: they are included! The shower is complete with the exception of the actual shower screen which I have been informed is normal practice in spain.
With reference to the comment that no Bank would supply a mortgage without a Habitation Certificate being in place , that is not true. I completed my purchase 2 days ago, with a mortgage from a leading
spanish bank. They have no problem with completing provided that the building has all the planning and completion licences in place. The Notary being used operates in San Pedro Del Pinitar, they are comfortable in allowing
completion without Habitation Certificates: Habitation Certificates can take upto 2 years to be issued in the Alicante/Valencia region. Properties can be bought and sold without them. The advantage of no Habitation Certificate
is that you will get no Utility Bills, you will be on builders supply for water and Elecric until the habitation licence is issued.  If you have doubts you should contact your legal representative, that is what you are paying them for.

I also do not consider myself to be a fool, I gave the matter plenty of thought and took plenty of advice. The advantage for me! On Saturday I will move into my house, complete with Escritura and Title Deeds. 
There will be problems and niggles, there have been plenty already but they are and will be dealt with in spanish time. Would I rather hang around and wait for another undefined period for completion or start living now, I made my decision,
time will prove me right or wrong.

As I said in my previous post the issue of sinks etc should be investigated by the individuals buyers as some buyers I spoke to have said they will be not getting sinks (which I also find rather odd).

On the issue of habitation licences -  it is a legal requirement now that if you sell a house under 10 years old you have to have a copy of the habitation licence together with a copy of the 10 years building certificate which covers the structure of the house (which means that if a builder stops trading for whatever reason you have a seperate independent insurance policy that covers any defects just as you would in the UK!)  as we all know things are changing quite dramatically in Spain regarding requirements needed for the sale of a house and about time too.

I personally would not complete without a habitation licence or  the 10 yrs building certificate, having had a house here for 8 years and also bought and sold, this is what I base my experience on.

I have  various friends who have bought off plan recently and all but one of these have been adviced to retain a percentage of the contract price to cover the completion of the communal areas. 

I work with a lot of early retirees/elderly English people in Spain who for various reasons ie: bad health, family issues, money matters etc find that shortly after moving to Spain have to move back to the UK rather quickly especially if they do not have private medical insurance/national health insurance and become very ill. They then have to sell their homes here in Spain and go back to the UK, a habitation licence and a 10 year building certificate would make the sale of a property a lot easier.

There is a thread on general threads EOS 'Completing On A Property' and then' Habitation Licences' there is some good advice on there.

Bernado, you obviously feel comfortable doing what you have done but not everybody would and I wish you all the best.
On a final note: it is not my intention to scare monger, only to inform. Remember how you would do things in the UK and don't do anything different here and that includes getting independent advice from a solicitor and not one recommended by the developer. Good luck in your new homes everyone.
