Hi Max
What is the point of having a one way strip of tarmac along the railway line. Do you mean only one half of the dirt track will be tarmaced and will be one way ( If yes, in what direction.) Does it mean we will still be able to use the other half of the dirt track to go in the opposite direction. I hope it does not mean the whole road will be one way only, so if you go to the shops or the beach you will have to drive all the way around, up to the motorway and back down again. I would rather it stays as a dirt track if that's the case.

Hi Irene,
At the moment there are no definite plans but surely will use this tarmac to carry their buggies, shopping trolleys and suit cases while walking to Don Juan. It will be a big relief to all of you.

I notice you mention Maximo's name, I thought he had done a bunk and departed GICS for good....Has he had a rethink or does he just like us....?
The water supply situation as you rightly point out is difficult to fix and equally difficult to understand. Correct me if I am wrong - it appears there are 2 main companies supplying water in our area namely Acusol and Gestagua and Gestagua have been granted the water supply rights by the Town Council for the Carvajal area which includes Don Juan. Despite this for some unknown reason our developer has linked up to a supply provided by Acusol rather than Gestagua so I presume this is illegal from the Town Hall's point of view. Nevertheless it transpires now, according to your comments, that Gestagua are both unable and unwilling to do the necessary works to provide a link to their pipeline leaving us in the situation that Acusol are looking for money, naturally, for the ongoing supply, which the developer is apparently reluctant or unwilling to pay. Perhaps our developer deliberately connected to the Acusol supply because it was easier and cheaper and he hoped to get away with it. The easiest solution would be to let Acusol continue to provide the supply for Don Juan, install their individual meters and we would pay our water bills directly to them. Gestagua might want some compensation to agree to this - perhaps the developer's guarantee (€80K) which was mentioned when the FHL was being granted could be used for this purpose. It will be interesting to see how this works out - at least it is good that the Town Hall appear to be willing to sort something out.

Deep down buried underneath lots of posts and topics I explained it earlier. As it’s a really important issue for all of you I will recap it.
Basically Acosol is a company set up by some of the costa del sol town halls as a competitor to Gestaqua (the mayor of Fuengirola sits on the board of Acosol). So logically they granted the license for our water supply to Acosol and Arrohabitatge did as ordered. However Gestaqua didn’t agree, claimed the rights and won the case. So the fault is with the town hall.
Buying them off will be next to impossible as this is all part of a larger battle about economic rights and Gestaqua sees this as an important victory for lots of territories on the Costa del Sol.
And yes, Maximo settled into some sort of agreement with Irma in which he helps her out with our community, but as far as I understand they no longer are one company.

Just a comment to add colour to the Maximo situation. Maximo is a good people person. He performs well at general meetings and at the town hall etc. but is not interested in administration. He parted company with Irma and now is the administrator of some of the communities GICS used to represent. GICS (Irma) is our administrator but calls in Maximo to help when required. Still confused? So am I! Personally I believe that while they have good intentions GICS with or without Maximo are not up to the task and we will need to replace them at the next AGM.

As the AGM has been mentioned, are we any closer to setting a date. We need to book our annual leave in advance, it would also be good to book our (cheap) flights as soon as possible. Can we assume that it will be around the last week of January? If so what's the problem in setting a date?

Having read your summary of the EGM, I am not enlightened any further as I do not have in-depth knowledge of most of the issues. That said, two items are worrying, namely the water supply and the road leading into Don Juan.
As I understand it, the water supply is maintaining its status quo following intervention by the Town Hall. What other strategies are in place to resolve this long term?
The access road is particularly bad when I visited in May. A single track tarmac does not sound like a solution but may make it a little easier to use. You mentioned a €250,000 compensation from Arrohabitgage for the lack of an access road - is this amount for the whole development and how was it calculated? I suspect the loss of value on our individual apartments is likely to be considerable in view of the lack of access road, water supply and postal services etc. With these known problems, who would want to buy a property in Don Juan as it stands????????

It seems like Max is busy somewhere else. I attended the meeting and I think I got this point. If not I am sure Max will correct me.
We had the legal report made of building defects, which included the lack of access to our development. The lawyer recommend that the matter with the access road should be seperated from the legal defects. Developer is not able to provide this road to us, as he does not owe the land and therefore he is not allowed to do any work there.
The lack of acces to our developments will be claimed as an compensation.
