For anyone still contemplating obtaining a refund there is an interesting thread dated July 2008 on the La Tercia forum which is a Peinsa development.
It talks about a notorial demand where you appoint the notary to obtain a refund directly from the bank, bypassing Peinsa and the agents. This appears to be a straight forward and quick process.This applies once the contract has been breached, i.e. completion date missed.

Which legal firm are you using?
I am using MJ Asesores, but I am beginning to think the have Peinsa's interests at heart, not mine & are dodging the issue hoping that I will be forced to complete.

We managed to get a full refund around may this year,took about 2 1/2 months on the basis they had broken the contract on the completion date.The solicitor was'nt cheep at e4000's but she somehow got us e7000,s in interest as well,which with the good echange rate we wear very pleased with.best of luck

On eye on Spain there is an interesting thread under La Tercia Real development - specifically a customer who via the notary got his deposit back with 6% interest!
He has invited anyone wishing to go down this route to contact him and he will happily guide you through the process.
Interestingly the builder is also Penisa - the whole thread is quite interesting!
