i am seeking to start a class action claim for recovery o f deposit against penarroya. i have been informed by martinez echavaria my spanish solicitors and by t he international law partnership london that planning has been revoked and habitation licence will likely never be granted. this will have serious repercussions re electricity/water supplies not to mention resale potential.please contact me if you along with others seek to recover your deposit only for a quick settlement on a class action basis    cheers chardonnay

This is nonsense and misleading Chardonnay and your solicitor ought to know better. Even Graham Blackburn will tell you that the licence will be released eventually, probably next year. Did you not admit in an earlier mail that you wanted your deposit back because you had bought for investment reasons. What's the real agenda here?

I am sure you will correct me if I am wrong, but I understood that the Spanish Legal System did not recognise class actions?

I have just spoken with my lawyer.  And she recommends I request a refund and go to court if i have to.  She explained that the Junta Andalucia said two years ago that the property was illegal, however the Town Hall disregarded this.  That is until two months ago, when the Town Hall accepted it is illegal and is now not issuing occupancy permits.

Just now the building (my flat is in manzana 5, block 2) is illegal - my lawyer has checked the documentation with the authorities - however the developer is saying it is legal.   I will not be able to get finance from the bank, and I am highly unlikely to be able to sell it.

The flat may be demolished or there may be a 'battle' to make the building legal. 

I am not willing to wait any longer.  This is a huge mess and a year and a half late.  I am getting out!

I really dont know, we hear so much re.occupation licence.  I thought we had occupation licence by silence, my solicitor told me so and I completed on 2 apartments in La Reserva.  I had no problems getting mortgage and I hope to re sell whenever the market picks up.  Im sure it will within the near future, after a settling down period and i feel we will all make money on our apartments in La Reserva if we want to sell.

The gardens of La reserva are very nice and will look even better in a year or two and hopefully it will be a much sought after location.  Its really up to ourselves to make the best of what we have and be positive about the whole thing and do our best to promote La Reserva.

There is so much panic, doom and gloom.

As I have said before, we have recently completed with no problem whatsoever regarding the license.  There is no doubt that it is possible to read into the situation to the point that there may be a problem if you want there to be one, as some people on here are choosing to do so.  Spanish law regarding any development in Marbella currently allows that to be possible.  There is evidence to suggest that all will be well in the future, evidence which is growing stronger by the day.

We have completed with ease.  Should anyone else wish to, but may require more information on how to do so, feel free to contact us.
