For now the developer is concentrating on pushing through completions on the linked villas which should generate some cash for him. He also still has the detatched villas to finish.
The situation on GOM is a very difficult one and each persons circumstance is different - and may even depend on how long ago you appointed a solicitor. A year ago the first thing our solicitor did was to get the signed contract back from Manilva Costa. At this late stage, if you don't aready have this back, MC have got wise and I don't think you stand much chance of getting one (fundamental if you wish to sue for your money back).
I would think that the only way the bank will 'step in' will be to repossess the properties if MC go bust - each of them has a mortgage on it. At that stage the bank would be looking to recoup their money so I suppose they might offer the properties to the original purchasers at 'cost'. The bank will only be looking out for themselves and won't be in the business of compensating 'purchasers' who paid deposits to a British agent who has since gone bust, and who have no contracts with the developer!
To be honest you can drive yourself mad with maybes and what ifs. You have to look at your own situation, get independent advice and make a choice you can live with.

i dont believ I have a cat in hells chance of getting any money back, but I am narked by the thought we may all have been taken for a ride.
If you google 'gardens of manivla' the 4th result that comes up looks like another company in England selling the same properties? Having grown up with Ester Ranzen exposing crooks it makes me wonder if OVP has just set up again under another name? Or am I just a Wogan suspicious old geezer?!

it depends it seems on having a bank guarantee or indemnity policy which I was told the money was bank guranteed however, it seems that was total crap.....anyone else have that experience or agree/ disagree??

The bank guarantee we had was a general guarantee for the complex.
This wasnt a guarantee for the money we paid.
The amount guaranteed was 2.500.00.00euro for 258 properties =each property gauranteed the sum of 9.689.93. or there about.

I have only been in touch with Vera Mates through my lawyer and she speaks / meets with him because she is legally obliged to do so. I wouldn't take a blind bit of notice of any instruction from OVP and instruct a solicitor to deal with her. All the things that are coming out of the woodwork means its far too tricky to deal with them by yourself.

Springermill - Website you refer to has been set up by another chap who bought on the site. He contacted me ages ago cause he is trying to get a 'community' together and trying to set up own rental company. Why did you pull out. Surely a property is better than expensive action in the hope of getting only half your money back (if any) ?
Helsmc - what is coming out of woodwork? My apartment is finished. I am strugglin a bit with getting a mortgage but Vera has been very helpful and I hope to complete early April. Valuations were well down as everyone expected but got reduced price out of Vera so going ahead. No chance of cash back ......is there ??
Also what's all the fuss about CUK. What did they do? OV sent us their details but we used local overseas conveyancing firm and they were fine. I have to admit that they didn't point out the bank guarentee issue but it is irrelevant now anyway as the site is built.

Were you sold an appartment under the impression that Gardens of Manilva country club would incorporate-
" An indoor swimming pool and fully equipped gym as well as a health and beauty area with a sauna/steam room, Also offering a bar and restaurant area, as well as creche facilities and outdoor childrens play area".???????? (I sound like an OVP sales man)
We paid an extra 10,000 euros to be right outside the outdoor pool, which for some unknown reason was moved to directly outside the developers block.
The fact that the apartments are significantly smaller than the plans.
The fact that we were sold an apartment with two bathrooms not one.
Oh just the small matter of no bank gaurantee of over 100,000euros deposit . Paying full IVA on the property price up front. You say conveyancing spain have nothing to answer.
And YES we have a very good chance of getting our hard earned money back.

Hi I know of someone who visited the site last week and said that the holes in the appartments are big enough to crawl through! Not good news. We are totally browned off with it all. Apparantly there were hardly any people working up there.
Has anyone managed to sort out an price redcution? We were offered around 7000 Euros. Take a guess what they can do with that!

Its nice to find someone that is pleased with their purchase on GOM. You seem happy enough so your property obviously doesn't have the issues everyone else's does. Like Tracey has mentioned, most people on this site have a list as long as their arms of problems preventing us from completing. Maybe you have bought a linked villa or somewhere on the site other than the apartments in Phase 1? I believe the apartments have the worst issues in terms of structural defects.
Like most people here, if I was getting what I was promised, I would be more than happy to complete. The site is in a beautiful location, fantastic views in a lovely part of Spain. I wanted nothing more than to enjoy a holiday home there. We weren't that bothered about the rental (and probably would have just rented to family and friends) and never planned to used OVP Travel to generate rentals for us anyway.
Oh, and all the 'fuss' about CUK is more than justified. Your property might be built to the highest standards, but my apartment is sitting unfinished in a block covered in cracks so big they can't even put windows in it. If CUK had done the job they were paid for and it had been pointed out that I didn't have a bank guarantee, we never would have proceeded. If we had a bank guarantee we would have executed it over a year ago, when we missed the promised completion date, and I would have all of my money back by now.

Two new contributors to this site. Gardens of Manilva.
We have been reviewing this site for a couple of months now, our story:
This will be very familiar to many. Like others, we originally purchased an apartment each on the Estepona Beach & Country Club development. We paid our 30% deposits plus the 7% tax and awaited the build and completion. However, when it became obvious that this development would never get off the ground, and after numerous complaining calls to Ocean View, we were given the option to transfer our deposits to the Gardens of Manilva development. We took them up on this, not wishing to lose our money, visited Spain and chose an apartment each on phase 3. We completed a property movement form and received a letter from Ocean View confirming that our deposits had been transferred.
The rest, to most of you, is history. We spoke with Ocean View on a regular basis but unfortunately still received the same info at the end, which was to contact Vera Mates. This we did and to be honest we had replies and even some very nice photographs of the apartments on phase 3. However this is the crux of the matter; - Vera Mates
e mails were fine except for one very minute point, the usual, VERA MATES HAS NO IDEA WHERE OUR DEPOSITS ARE.
I can’t believe we were so naive, we assumed, reading the Ocean View pre sales brochure that our deposits would be safe and held in a designated client account until the bank guarantee was in place. It is quite obvious that this guarantee has never been issued. This looked to be confirmed in the solicitors contract pack. Like others we signed and initialled each page and sent back to Ocean View.
We have also e mailed sbs admin and still await a reply (any thoughts on any dealings with the administrator or sbs would be welcome). Also can anyone point us in the direction of a knowledgeable solicitor who will be able to approach the developer on our behalf?
We are willing to listen to any ideas with regard to joining a forum for a return of deposit or if heading in the direction of completion, any news on the deposit or availability of mortgages. We are beginning to believe that we have a case to cancel our contacts and in fact in the long term it may be the correct thing to do. At least we would not be committing ourselves to purchasing a property not worth its original value, no mortgage available, and no rental guarantees.
We are open to any suggestions, we have noticed that this site contains differing views and it’s true that we still have no idea of the best way to proceed. Any help would be welcome.

I'm not sure if you were being sarcastic to me, as my previous post looks out of context now. If I genuinely made you laugh....then I'm very happy. Laughter seems a rare occurrence these days.
