Contracts

another question, the contract we were sent by our solicitor makes no mention of the original completion date, however, we now have laid our hands on another contract signed by him on our behalf which is much longer and states a completion date of 28th July 2008 (+/- 4 months). We were wondering whether anyone else's contract they were sent was the short version with no date or the long version with a completion date? Furthermore, when we asked in the Romanber office about the date we were told it was a typo and that it should have read 31st July 2009 and that our apartment was actually due for completion around May 2009 - several months early!

We also have two contracts for our property. One between Romanber and Sunset which states 31 July 08 as the completion date (+/- 4 months), and then one between us and Sunset where Sunset transfer the purchase obligation to us. The latter does not mention a date. Our lawyer (not Luis Mendez) explained that the second contract takes Sunset out of the equation so there is no impact following their demise as the contact is effectively between us and Romanber.

When we checked in the Romanber office last month they had copies of both contracts, but did not have our Lawyer's contact details. They were just going to contact Luis Mendez when the time comes to complete, which is of no use to those of us not using him. If you are not using Luis I suggest it is worth checking with the Romanber office that they have the correct contact details.

We recently appointed a new lawyer who contacted Romanber and their initial reply is that they have no record of us as purchasers in their database and no contract with us and that we should refer our request to the agent from whom we bought the property. this is despite the fact we were offered the same assurances as other Sunset clients (i.e. that our money was safe and the contract was now between us an Romanber).

Our lawyer will not be able to speak to Romanber until next week so it could be just a mistake on their part but I am assuming they are well aware of Sunset's demise, given the headache it has caused them, so I don't understand why they are referring us back to them.

That is concerning indeed. I do hope your lawyer can resolve this next week. Let us know if all goes well.
