Hi all
I am wondering what is happening with TH and the MAG group are we still getting together to get our deposits back or is every one going for the dicount and then going ahead with purchasing on TH.
How do we get the discount I have not been contacted by TH so have no idea

I have sent out the information to the group and each indiidual gas to decide what is best for them. We negotiated a deal for legal fees with 1/3 rd reduction. We should also remember that part of our motivation was to get the development moving and so far that seems to have taken a step forward. My PERSONAL VIEW IS THAT the reason for the discount is to determine the number of buyers that are still going ahead with their purchase and depending on this figure The banks will decide whether or not to back them. each person has to decide for themselves what is best for them.

If this reads the way it sounds this means that we have reached the end of this particular road and now need to move to legal action against Trampolin Hills and the Town Hall. Or am I reading this wrong?

If this is 'old news', then why is it being published in an official document that is produced on a daily basis by the Ayuntamiento?
There is no mention of these embargoes in any of the previous BORM publications this year, therefore I can only deduce that something significant has recently happened regarding these actions.
I have posted this information on to another forum frequented by lawyers and industry experts for a more informed view, the responses so far have stated
'It seems that their creditors have placed a Court order that will stop them from dipping their hands into their bank account at the determinant of their creditors'
and
'In English this is chapter one bankruptcy!
The first stage in moving a company into administration.'
I am no Spanish Law expert, but given our experiences with the same developer on their Lo Santiago development, it sounds like an official act has taken place to prevent the syphoning-off of company funds into a black hole.

Just to add
Have been advised by solicitor, embargo could be due to unpaid taxes (same reason as last year) as usually in Spain the authorities can freeze the accounts until taxes are paid.

My understanding of things as they stand are, TH are effectively bankrupt. All monies paid in by prospective purchasers (of which I am one) is at this time unaccountable. Sad, but true!
A numbers of clients have now issued court proceeding against TH and judgements has been in their favour. But due to the fact that TH are all but financially embarrassed and or still refuse to honour their Company Guarantees, a lien has been put on all sites/plots involved in these cases. So, as things stand TH must firstly refund clients their deposits, before they can then go about selling these sites/plots again.
With this in mind and when you also consider that there are now also a great many more deposit claims pending judgement. I'd say that TH are well and truly snookered!
It is my belief, that even though permissions have supposedly, now been granted, this development will never go ahead. The current global turn-down, combined with gross mismanagement by the promoters has combined to deliver a killer blow to TH. I have taken the lead from others and started legal proceeding against TH. My advice to you is, do the same!

this has been very informative and we have now contacted the company Gerry has dealings with to get our deposit back
We would have been lost without the forum & MAG so thank you all
we will keep you posted as to our progress
