All Phase 1 owners
I have just received notification that there will be an EGM on Wed 21 October. This meeting is being held with reference to the problems with my neighbour.
I would appreciate as much as possible support on this matter because if it continues the resort , our lifestyles and investments suffer. Please send me a private message if you need any more details.
Also thankyou to all the owners on other Phases who continue to send me messages of support

Thank you to all who have sent me messages. Unfortunately I cannot reply to you all individually so please do not take this personally.
The meeting is Wednesday 21 October 2009 at Housing Comunidades office, 100 Avda de la Union, San Javier. If I can recall, this is the road which would take you to the large Mercadona, Wok Buffet etc. The meeting will take place at 1030 am and if a quorum is not present, the meeting will reconvene at 11am same date. Unfortunately we cannot be there, due to work committments. We therefore cannot accept proxy votes, however I have emailed our President (peter beard) to ask if he would accept votes. Then all you need to do is to send the form back to the community office.

I have just received an email from our President, Peter Beard. For those of you who wish to vote and cannot attend the meeting, please fill your name and property number on the form. If you want someone else to vote for you, please fill in their name. The President is willing to vote on your behalf. Please don't forget to sign and date your form.

Hi
We are voting on removing the tenant who has caused a lot of trouble over the past year. There is obviously a lot to tell but theres a thread on the matter. The community are hopefully trying to remove the tenant because of the constant dog barking and the excrement and urine which is constantly being brushed down onto my terrace. There is another issue but this is being dealt with through the court.
You should have received your voting form by now, I received mine last week.

How much is the EGM costing us?
If it is that important would you not be there?
From reading the previous posting I know I would make the effort and show my supporters how much I appreciate their votes.
We are flying from Birmingham on the 18th and will be at the meeting to vote for you but I feel you should make the effort to be there also.

I am trying to be very diplomatic in posting this reply.
I have said in other postings, my husband cannot attend the meeting as he has very important work committments. It is vital he attends meetings, his job pays for our property in Spain, he therefore needs to be a reliable employee. I also work and my work roster is sent out 7 weeks in advance. Whilst I could maybe try to swap (this involves certain requirements) my duties, I am not comfortable visiting Roda by myself. I will not go into the issues on this post, but I am sure you are aware there is a criminal proceeding issue and until this is sorted, I do not intend to visit Roda. The President and the administrator are aware of this and understand as do other owners.
Please do not give me a hard time. Whilst it may seem simplistic to you, this is very difficult for me. Whilst I appreciate your support, I am upset that you have tried to make this somewhat more difficult for me. My decision was not taken lightly.

I am fully aware of your situation and the difficulties that you have had and am monitoring what actions will be taken very closely.
My earlier question was aimed at what is the community actually voting on?
The letter from community administration says to 'initiate legal proceedings against the property 01-16-2-A-AA ETC ETC ETC'
What I am asking is what legal action are we voting for i.e. against the tenant? against the owner? are we forcing the owner to get rid of the tenant? or are we taking legal action to force something else?.
i.e. what is the outcome we are voting to achieve?
I appreciate that we would all like to vote to pull the tenants arms off and hit with the soggy ends before chucking him in the pool, but if there is a winning vote to initiate legal proceedings which the community wins - what will happen?

I sent a message to Marisol a couple of days ago to which she replied yesterday.
From what I can understand, we as a community are voting to evict this tenant from the apartment and resort. If we get a favourable vote from the community, this will then go before a court. The end result which Marisol is hoping for is that the court will make a ruling and if this person tries to rent another property, she will have the paperwork (some sort of order I presume) to go to that owner and have the person evicted.
I do however worry that the owner (offending apartment) who appears to have been totally dismissive in the past will rent to another unsuitable client. I have made Marisol aware of my worries.

Thankyou to all who attended the EGM yesterday and those of you who sent proxy votes.
Obviously we got the vote we needed and as far as I know the next step is for the court to evict this tenant. Hopefully I will hear something from Marisol or Peter(president) over the next few days regarding the issue.
