Well i have ecentually chosen my solicitor forwarded all my stuff to them and paid what was needed and i am now OFFICIALLY a registered CREDITOR of trampolin hills cant beleive its came to this but we will see what happens, fingers crossed that theres light at the end of the tunnel.

Congratulations!

From everything that I have studied and learnt and been privy to, employing a Lawyer is the only way that we can hope to see a positive result. There is light at the end of the tunnel and I hope that everyone is smart enough to employ a Lawyer before tomorrows deadline and to have their claims registered. The process to register the claim in the right format and with all the right papers is a minefield. I have read the forms!

With any luck the homes bought will be built and everyone will have their dream homes!

Hi All

Well have to say I'm not at all confident that we'll receive anything but like many others have already appointed lawyer who ha salso registered me as a debtor.

Apart from recourse from TH themselves I still do remember a judge commenting that as the council were fully aware that TH were selling properties on land for which there was no planning approved that the council were also culpable and might be required to contribute to cover any loss by buyers. I think I've got a copy of the article somewhere. Does anyone elkse remember this.

Buyers at the Trampolin Hills residential golf development in Campos del Rio could suffer “massive losses” as a result of planning irregularities at the resort, a judge has warned.

In a statement on the 12th May, reported in Murcia’s regional paper ‘La verdad’, judge José Miñarro García said properties at Trampolin Hills “appear to have been sold without appropriate administrative licences.” The developer admits that most of the resorts 2,575 properties have already been sold.

The judge condemned the municipal government, run by the socialist party, for turning a blind eye whilst hundreds of properties were sold without all the appropriate planning permissions.

In a little bit of good news for owners at Trampolin Hills, he also stressed that the town hall would have to compensate buyers for any losses resulting from a purchase of illegal property at the resort, not far from the city of Murcia.

“If buyers suffer massive losses, which is hypothetically possible, then the town hall, having allowed the construction and well publicised sale of properties without appropriate planning permission, is clearly responsible for damages,” Miñarro is reported to have ruled.

The ruling is a result of legal action taken by the opposition Popular Party (PP) against the Socialist-run local government, whom they accuse of changing the urban plan for Trampolin Hills without the support of the town council, as required by law. Some socialists are reported to have private business interests in the resort.

The judge also ruled that opposition PP have right to debate and vote on planning decisions relating to Trampolin Hills, and demand a halt to all works until the project has all pertinent permissions.

The judge said this would help to prevent a situation in which demolishing illegal properties at Trampolin Hills was ‘socially and economically’ unviable.

Trampolin Hills has been marketed heavily to British buyers, offering estate agents commissions of close to 20%.

the time is now very close to the deadline for the registration of creditors in the Trampolin Hills Resort. I have been in private contact with a few people and one or two only are still convinced that they do NOT need a Lawyer to help them to get anything back from the THR. It is true that you dont need a Lawyer to lodge your name on the creditors list, just as it wasnt required to use a Lawyer or to get a Bank Guarantee from Antonio when contractes were first signed. If everyone had bank guarantees nobody would be in this state! However, in Spanish Law a private individual can NOT represent themselves in Court and that is where this administration is at the moment and will be until the issure is resolved.

If Creditors are capable of completing the Spanish forms required by Court to register as a creditor and IF they manage to send all the right information, they will still NEED a Lawyer to represent them at the next 2 stages.

I know that its hard to invest a little money in a Lawyer after losing so much already but if there is to be hope then you have to EMPLOY the people that can provide that hope.

We can all e mail and moan and be a group of impotent disgruntled purchasers but in the end nothing changes the fact that THR is IN Administration and the only hope of seeing anything is by taking the right path.

Phase 2 by the way is when the Creditors will be called in order to find a way of how THR can pay back their debt. Representation is by Lawyers only.

I wish you all the luck in the world. I however think its going to have nothing to do with luck and everything to do with hard work on behalf of the Barristers. I never met a Barrister yet that would work for free as is suggested by a no win no fee deal. Barristers in Spain are just like they are here and work on an upfront fee. Anyway the important thing is that you have got yourself on the Creditors List. At the moment that is the most important thing. The only thing that is important. Congratulatiuons on getting that far and having a Lawyer represent you. Lets hope that everyone has been as smart. Its still a shame that everybody didnt use a Lawyer in the first place!

Thanks for your comments, and sorry for any confusion, the Lawyer has an initial fee of 850 euros and then when he wins the case and money back i.e. deposit etc he gets a % of the final figure which is agreed beforehand.  If he does not win the case, there is no other fee then the initial 850 euros.  People are involved in this and it works.

I am not actually involved in this development but do want to help people if they are interested in this.  Many people have spent far too much money on the unscruperlous Lawyers and this is a genuine offer of help, there are Lawyers offering this kind of deal now but you have to have a good one who knows what he is doing.

Thank you for your reply. Where have you bought? Did you use a Lawyer when you bought your palce at the first instance? How did you find this Lawyer to be trustful?
