Hi to All

Still haven't heard of an official completion date has anyone else? I found a site stating ready for occupation in August 2007? So I think we must be looking for a realistic September/October completion or may be even later if the licences haven't been issued before the August shutdown. We shall see.

Hi

My first time on this site- so hello to everyone!

I have just come back from an inspection trip and I have to say all is looking good. I was informed that a realistic completion date would be October now as the first habitation licience has been lost in the august shut down. Ahh...

I have bought in block A first floor. Anyone else in this block? I have a slight concern about the land in front of the block on the sea side. I am told it will be sold for commmercial use only and will only reach 1 storey. However, this hasn't been officially confirmed and I am worried that I will loose my sea view if a new 3 storey block is built. Anyone have any clues?

I did take photos whilst I was there, but on a disposable camera. I will try and scan them in when they are developed.

Hi Lizzie

Welcome to the forum,  I have also heard that its commercial use in front and more than likely to be a one storey supermarket, I havent heard any further news on that though.  I was hoping things would be completed by September, do you know if we get any type of compensation as if I remember they planned completion to be Feb 07 initially??

btw if you take a disposable camera to a Boots or larger photograph developer they can now put the photos on a CD for you from a disposable camera

 

How did the apartment look? was the interiors complete now?

Hi Lizzie

I presume you have bought in one of the block 3 4 5. I have bought in block 1b on the second floor in August 2004 and as you can imagine it has changed quite a lot from when I first saw it. I have lost some of my views but not to the extent of some and I feel very sorry for those in block 2 who are totally blocked in and have no views whatsoever. Originally I was told that there would be a low level supermarket built opposite the Calanova Beach Golf apartments along side the road up towards the Oasis going up towards block 1. The land now is going to be now more apartments. I never imagined they would have built so close to blocks 1 and 2 especially how the land lay back then.  When I was over in April the land in front of blocks 3 4 5 we were told was not going to be built on at all so if they do build a low level supermarket there at least the views will be intact. One thing is for sure never believe what they tell you.

Fingers crossed for an October completion as I cannot see it being any earlier and wouldn't be surprised if it's later.

I mentioned earlier to Kaush and Cookie a bit closer to completion we could arrange to get the snagging arranged together along with any others interested to get a keen price and save time.

Hi all

I think there is some confusion about the different plots of land being talked about. Lizzie, do you mean the land to the "south" side of block 1 adjacent to the Cala Azul developement? As far as we know the land in front of blocks 3,4 amd 5 cannot be built on and will be a green zone and the land to the side of block 1 is going to be commercial but as we all know you don't know what to believe although Kaush did say he got the land @ the front of blocks 3,4 & 5 checked out independently.

A friend was over a couple of weeks ago and apparently some people have moved into the developement, which can be done before getting the habitation certificate. Certainly from a health and safety position the development is not quite fit for purpose.

Perhaps all of us should ask our respective legal representatives the questions regarding the aforementioned parcels of land and feedback on the responses.

Sorry I have caused confusion over the plot of land I mean! The one I am refering to is the one you drive up by to get to the complex which would be on your left coming from the dual carriage way, south side(?) The block I have bought in is the very first block you come to which on my contract is referred to as Block A.

I think the best idea is to do as suggested and that we all contact our own legal representative and get an answer once and for all.

I love the idea of us all being there for snagging - seems to make sense and should give us negotiation power.

I'll uplaod my photos as soon as I can. I have to say that the finish is excellent and the attention to details really ggod. There was someone living there right under my apartment so not all bad!

Hi Everyone

The land I was refering to was opposite the Calanova Beach apartments on the road up to the Oasis which is now going to be apartments. I presume Lizzie means the land directly to the left of block 1 which is going to be a supermarket. One thing for sure it going to be pretty full along there.

I have posted a photo in Construction Photos showing the land.

Have heard today (22nd August) that the occupation licence and nota simple has not yet been issued so it is looking closer now to a September?? October??....completion. Anyone else heard anymore?

We are new buyers of a garden apartment inblock 2.We were last there in September when they were just finishing our swimming pool.  They look brilliant but the only view we have got is the new apartments they are building opposite.

We would like to know more about snagging.   We hope to complete by the end of November.

We are going back again 14 October Would like to meet up with anyone who will be there then.

My lawyer is still unable to give me a final completion date so that I can sort out my purchase. Does anyone have any clue as to dates? Will it be this year? I certainly hope so!

Hey there

I spoke to my lawyer and to the agent (just about!!) and they are saying its due to complete within 2-3 weeks.  I also got an email from my lawyer explaining that the developer has preferred rates with a bank should we wish to go through them for a mortgage.  I am currently also looking at banks in the UK for this too.  There are the final costs (fees) that I want to try and include in the mortgage.

I am suprised that IPS have never notified us of progress, it has always been people chasing to see what is going on and getting updates, just seems strange after paying so much for a property??

Oh well :-)

If I hear more I will let you know, in the meantime I guess a snag list should be done fairly soon now?

Thanks for your reply. I have to agree it is strange we are chasing them as opposed to the other way around.

Also, I have found a very friendly mortgage broker in Marbella if you would like his details.

Has anyone been able to negotiate with the price due to the delays and the apartment block in front blocking our view?

Hi everyone

I emailed my solicitor late yesterday and await a reply on a completion date. Will let you know if I hear anything. I agree another 2-3 weeks seems to be about right in what the Calanova Sea Golf waited after the LFO was issued.

I can't believe IPS they have been a poor show for such a long time and it seems to be a one man show (or woman in this case). Useless comes to mind and that is being polite.

I think after taking advice that I shall do the snagging myself. I am compiling a list at the moment from various sources This is one British site with some excellent infomation. It's just a case of how good my Spanish is to translate for the developer may-be with photo's it will be good enough.

 Hi Everyone

Have received a reply from my solicitor and contrary to what my mortgage broker told me the LFO has not been issued to the developer yet and has no idea when it will be so who knows when completion will take place. I understand there is normally a 15 day period from obtaining the inhabitation licence and then a request from the developer to complete.....  so we might just make it for Christmas if we are lucky.

I tried contacting IPS but not with much joy.  Just out of curiosity now that the development has been delayed potentially a year from original completion date should we be looking at any form of compensation?  I have delayed my move over so many times now, each time giving my notice at work that they just laugh it off now :-)

That was a very detailed checklist you had there, looking good..I think with xmas in between I am looking realistically at Jan to be safe forcompletion, besides really not keen on moving in december :-)

Well thanks for the update everyone and lets see what happens.  I am using my UK mortgage broker for getting that setup for Spain,  is anyone going to use the developers mortgage deal?

Thanks for the updates!

With regards to compensation, I have to agree that we should be entitled to something. I bought mine to rent out as well as for my own use and will be trying to claim loss of income. I have asked my solicitor how to go about this and he is getting back to me. 12 months is very late. I too have tried to contact IPS but jhave had no luck.

Can anyone tell me what the LFO is? I understand the licience part but not the LFO.

I have to keep looking at the photos to remond mtslef how lovely the apartments are!!

This is the last number I had from my solicitor for IPS 0034 952 471361 it is different from the La Cala office number now it is shut. No Idea if Nel is on the other of the line still.

LFO is  licence of first occupancy.

I agree with kaush, may-be the new year now.

OK I have just had a reply back from my solicitor, I had also asked for details of compensation but doesnt look likely

 

"I hope you are keeping well too.
 
Property is almost ready for completion. The Town Hall has already approved the first occupation license as per the information provided by the developer. We are just waiting for them to send us the document.
 
I am afraid that completion was expected for February 2007 as per the report on title that we sent you, in which is stated also that the developer can delay completion for 12 months because of act of God, so I don't see any way to ask for a compensation at the moment.
 
As soon as we have the copy of the first occupation license, I will keep you informed."

Hello everyone,

We have just been surfing the net for updates on my apartment in Oasis La Cala and we have found this website, what a brilliant idea ... :-)

We have purchased in Block 1b on the second floor and are keen to move in hopefully before Christmas.

Like everyone else, we are waiting to receive information from the Solicitors ( Manzanares in Marbella as recommended by IPS ) we are currently receiving more information from the mortgage company than the solicitors. To date we have received only a handful of emails from the solicitors asking us for money but not providing any progress updates or information.

We visited the site in May and wereformed by Nell from IPS and the Solicitors, that the development should be complete by July 07, then the second fortnight of Sept 07, presumably she meant at the end of Sept 07. Now its nearly the end of Oct and still no news.

Is there anyone else on this website in Block 1b ... second floor ???? Or is there anyone with any new information ???
