having spoken to other people living on complexes (urbanizations) that have moved in without L.F.O and free builders electicity and water It isnt a good idea
1/ electricity...builders electricity has been known to surge of even cut out altogether without notice
2/ water... builders water has been known to be contaminated at times without notice and also to disappear for days
3/ LFO ... careful here because once you have signed , the builder can say "it isnt our problem anymore you have signed for the property , utilities are now your concern not ours"
we are not saying that taray will do this because they have an extremely good reputaion but caution is always recomended. Would you sign for a house in england without utilities?????
We ourselves intend to look into this matter and approach taray direct We will keep you informed

Hope you have got our emails to say that we have decided to use our flights & come out this weekend after all. As we are so near completion we would like to investigate this further & feel that it will be easier when we are out in Spain - the communiaction whilst you are over here can be very slow.

I did ask our owners club this but maybe someone out there can give me a straight answer.
Does the LFO have to be applied for after each phase or is it that once this LFO (you are all disscussing) is granted then thats it for the whole site? Just wondering as ours is due to complete March 2008 but im wondering if like you guys we will be waiting ages for the same licenses.

We wish we could give you a straight answer, because we would like one to so any news from your owners club would be good.
I think we are all bemused by the LFO. We were told by Carrie at Taray when we visited their offices on the 28th January that we would get the LFO once the site was finished sometime next year, but have since been told by our solicitor it will be approximately one month and a half after we have completed. We all seem to be getting different stories about it!!
We have also heard that Taray will only apply for it once the site is in a fit state to ensure that it passes, otherwise if it is rejected they have to apply all over again - this has come from our agents!!!!!
Does anyone know if the LFO is granted by the same people as the land registry, because as the land registry has not been granted yet 12 weeks after applying it doesn't give us much hope for the LFO?
All this will be worthwhile once we are on our patios in the sun!!!!!!!

Hi Tina,
We were told by our solicitor last week that Taray would apply for LFO phase by phase. He had an email from Taray stating they have not applied this licence for our phase yet. ( phase 1 ) I will now contact our solicitor to get email or fax confirming in writing if; (a) they intend to apply this licence phase by phase and (b) if this is the case,when exactly they intend apply for our phase ?
We all need this information sooner rather than later and verbal promises from Taray just aren't good enough anymore.
If anyone gets statement from Taray ( in writing ) meantime, we all would be very interested to hear !!

Dear Sue & David,
I believe the LFO is granted by the local town hall and not the Land Registry (thank goodness)
See - License for First Occupation (Spanish property process) - This license is issued by the Town Hall and proves that the property is suitable for human occupation and to be connected to the electricity and water supplies - which I copied off some internet site or other...

Story keeps changing eh?! Well I hope these licenses get sorted for you guys soon and then when it comes to the 3rd phase completeing we may be after a bit of advice from you guys. Us 3rd phasers will just have to sit back and see what happens. I will be getting in touch with our spanish solicitor soon regarding a different matter but if i can find anything out that is different to what you have said i will let you know.

We have now cancelled our flights so unfortunately won't meet up with you on this occasion, hope you have a good time & perhaps there will be some good news on the land registry whilst you are out there.

Going back to the question i asked a few days ago, it looks as if yes you are right the LFO is applied for phase by phase................. so we can forget completeing in March 2008 then, i bet it will be more like July!!!!!

Hopefully after all these initial hiccups perhaps all the processes will start speeding up by next year as it must be putting a lot of pressure on builders finances in the area.
The most frustrating thing is when your house has been standing there ready to live in since early November last year & you can't complete on it !!!!!!!

im going out on monday to give tarray 14000 i feel like keeping it in my bank after reading these posts

my solicitor told me i should give them 3 months after completion date

Hi All
Anyone heard anymore about the Licence of First Occupancy lately?
We are on phase 1 and the expected completion date on our contract was 31 Jan 07.
We have 2 weeks hols at Easter and would have liked to have gone over and bought furniture etc. If nothing is happening by Easter I don't want to waste our hols and will take the opportunity to go elsewhere.
On the other hand I don't want to go somewhere else if it is all sorted!
Don't know what to do for the best!!!!!?????

We had an update from our solicitor on Friday. Hopefully the land registry documentation is fairly imminent now, but she confirmed that Taray as yet have not applied for the licence of first occupation as they are waiting for the land registration documentation. Apparently the town hall needs to see the land registration documentation before they will even look at the licence of first occupation.
From what we can understand the San Cayetano development is on mains power via the builders rather than on a generator. We have checked this out with several friends who live in the area & all they keep telling us is that Taray are a reputable builder & they will get the licence of first occupation - they have on all their previous developments. The horror stories about breaks in power are generally due to generators breaking down
However, it has got to be up to individuals as to whether they want to sign without it being in place
Our solicitor will not let us sign until the land registration is complete as in law your house does not exist until the horizontal splits are able to be transferred, but she is happy for us to sign without the licence of 1st occupation
Wherabouts are you buying on the development? We are in the same situation as you at present as we are due out on 6th April for 10 days & have already cancelled a week at end of Feb.
Frustrating eh???!!!!
