I hear on the grape vine that HUMA owe so much money to Ferrovial that they have decided Ferrovial will complete the houses already started on ACC to try to get their money back.
Apparently Ferrovial have got planning permission to start work and are appointing local companies to complete the work.
This comes from a Spanish source involved with one of the companies who have been approached..
Something which has puzzled me was why they kept the gardens around the show houses well trimmed but the houses have had the AC units etc removed.

Regarding the AC units they have probably been collected by the supplier due to non payment, just my guess anyway.

Interesting - here is a thought.
I like many in the earlier days received my money back but not my deposit. can they sell my apartment with my deposit still being held by Huma?

If they (Huma or Ferrovial) complete your ACC property (or ex property as the case might be now) then we should be able to place a 'debt' against that property or plot. (i.e deposits or money owed to previous purchasers).
I understand that in Spanish law you can not sell a property with a debt against it or the new purchaser has to pick up that debt and replay it !!
Are there any experts reading this that may know more detail and if this is true ?

I too think that you can place a "debt" against the property for the deposit as it is exactly that, a deposit on the property, however, how do we stand with regard to lost solicitors expenses, interest etc...

When we signed our contract in Humas office, we were told that the 3005 euro deposit was non-refundable. There must be a lot of people who got a refund but never got their deposit back, so Huma must have kept loads of money if we all paid 3005 euros.
It would be great to get the deposit back but our solicitor advised us that by the time we paid him a fee, it wouldn't be worth our while. ( We still haven't got any stage payments back , the longer it goes on the less hope we have)
I would still be interested to know if all of those properties could now be sold, because, really , we all hold a deposit on our plots at ACC. Knowing Huma, they will have found a way around keeping our deposits and re-selling the properties. In our experience, the Spanish just use or ignore their laws to suit themselves.

We need to contnue to keep an eye on what is going on, there are many hundreds of people who have been ripped off by Huma and I believe the best chance of getting your money back may well be if someone develops ACC and then has problems selling the properties as we all have deposits on them, remember the Spanish legal system is very slow, that could be to our advantage in the future if a developer wants to sell properties!!! It might well be cheaper for them to settle with us!! Anyway, strength in numbers I think!

Agree with what you are saying. We should all keep an eye on ACC and it would be fantastic if a developer had to offer us a payment to allow them to sell on our properties. But on the other hand, Huma sold us our properties believing that all was legally in place, and look what happened to us ! So there is nothing to stop another developer from selling our plots and not telling the buyers the full story until it is too late. Duped -- just like us. There are plenty of unsuspecting people who have no idea about what has happened, even in these times of internet communication. Another developer could easily make a killing before the spanish legal system catches up with him.
What do others think ?

I suppose the answer is to somehow put the debt that Huma owes you on to the plot number so that when the buyer's soliciter does a search before signing up to buy the property then this shows up and has to be dealt with.
Need experrt advice to enable this to happen.

Antojo, there are enough ex ACC people living in the area to know if and when ACC starts being developed again, it would be easy to visit the site and make people aware of the previous problems and possible future problems. We would nee to make ourselves a pain in the aaaaa...rm!!! I'm actually going out to Spain in a couple of weeks time, I might shoot down to Huma's office I think, just to be a pain and let them know that I haven't forgotten!!! Hope the boss is there, hope his car is there............

Don't want to dash peoples hopes, but I have spoken to our solicitors today about the supposed Ferrovial takover and they are not aware of it and as far as they are concerned there is NO planning permission on ACC either. It looks like just another rumour, although if it were to happen, it would certainly help us all.

as we live on camposol(50 mins away) we can assure all that nothing is happening on acc, we were there last tuesday, although the grass has been cut and the show houses look good, all the show houses and offices are unlocked.
we got our money back and bought on camposol, but no 4 years interest on our loan of 69.000e to huma.

I do believe that one day (and probably not too far away) building on ACC will resume. Reports coming out (if you believe them) state that the property sector is now starting to pick up in Spain. ACC was always a sort after location and it will be again.
Wether it's Huma, Ferrovial or a n other that finishes the site remains to be seen.
Huma, I fear, will pass the buck and sell the site (keeping all the money many people paid in deposits and installments.) and try and run !
What we must all do is keep reminding them that the OWE everyone a full refund.
It may also be prevelent to write to Ferrovial and put them in the picture so that they realise they take all of us (and the debt) with them if they purchase ACC and we will pursue them for full refunds as well.
Remember, that your ACC plot has YOUR NAME on it unitl they refund you AND CLEAR THE DEBT.
Where do we stand if the site is sold by Huma ?
