Can anyone answer my question?.....Always supposing I manage to send this message off as am quite 'stoneage' with regards to emails, blogs and the like!!!!!

Has anyone started legal action against Interlaken on the grounds of 'Mis Rep'? Has anyone started any legal action at all? We have just been advised to do so BUT the courts in Spain work at a snail like pace...and years have already passed. Is there anyone out there with any advice? Stories, horror or otherwise to relate?

Many have started legal action...I finally started in 2010. I was told I had a bank guarantee by Lawyers of Spain (who were associated with Andalucian Dream Homes) but this proved to be false. The bank guarantee was between Interlaken and Med Lux Homes (Ocean View) so I couldn't go that direction!

I now have maria from Costaluz lawyers dealing with a multiple action. I think you should contact her....if you mention my name she'll know your determined to sort this out. Interlaken 2003 SL were incorporated by a larger company that went into insolvency/bancruptcy earlier this year ...so the bank is now responsible.

I also believe that the poor build quality etc is down to the corruption in Casares town hall. Owners can beautify the site as much as they want but the build quality is terrible.

I first started to do something regarding my 30% 'bank guaranteed' deposit (according to Lawyers of Spain) in 2006, when i learnt that my 'bank guarantee' was not an individual one, but an enmasse one between Interlaken and Ocean View. I spent about £2k at that point. As I had another fight on my hands I only got to see Maria from Costaluz in May 2010 regarding Casares. I signed a power of attorney and paid 5k Euro for disbursements. I have my case heard in Estepona tomorrow - and will be so happy once it is sorted. I paid the deposit to Lawyers of Spain and (without a Power of Attorney) they did all the negotiating on my behalf. Never trust a lawyer if the estate agent recommended them as they aren't working in your best interest, even though your paying them!

I'll keep you updated - but I would recommend sorting things out - you never know what the outcome will be, but if you just don't do anything you'll NEVER know how things may have turned out. I know quite a few people who turned their backs on large deposit sums rather than go through the mill.
