Latest (hedging her bets) reply from Jane at Atlas : "going by what they have said it could be April more than March".
Now, Easter is April 6th to 9th - flights around then are bound to be more expensive, so I expect Ailsa and I will be looking at mid to late April - if we get the go-ahead for April.

(however, as an aside, I am running in the London Marathon on April 22nd so I expect we wouldn't be going out until after then - so we're now almost into May....well, at least it will be nice and warm then!)

OK - so really just what we all thought any way. And let's be honest - April will be such a good time to take over our properties! Good weather, lots of outdoor living etc etc. Now, as to where we complete - I think it is usually in the lawyers office. We are using Atlas, so I think we have to go to Torrevieja (excuse my spelling). And Atlas told us that we could just get our NEI numbers when we go over to complete, as long as we can stay for a couple of weeks. I think you should stop reading about the Almanzora Country Club, Judy - it is very upsetting. But even there, there does seem to be some better news. These sites were halted long before they got to where ours is - so I am assuming, hoping that we are ok. Best wishes, Linda

Hi All

I have spoken to my spanish solicitor today regarding another matter and have taken the opportunity to ask them about the completion date and what happens if the builder runs over. My contract says that "the sellers bind themselves to deliver to the purchaser the property along with the corresponding urbanisation which shall be completed in the month of December 2006". There is nothing in the contract to address a situation if the builder does not complete on time. The solicitor advised that according to spanish law it is permissible for the builder to overun by 6 months without any penalty due.

So that's possibly end of June 2007 then !!

Just looked at our contract and although we were told at the time we signed the initial contract that the builder would be allowed to complete within 3 months of the expected completion of end December without penalty, there is nothing in the contract that actually mentions this.

However ..... our Atlas personal adviser stated the following in an email to me on 31st Oct : "date still provided by the builder is 31/12/06. However, after viewing your last report and photo, I would say realistically the builder may go over the date and use the 3 months clause which means February or March.".

Having been told today that April is more realistic then not sure what happens in terms of the builder paying a penalty (as there's nothing in the contracts, then I suspect he won't have to ....)

Hi Everyone

Iv'e been hearing a lot about Spanish  builder's not having planning permission, can anyone confirm if planning permission has been granted for Los Olivos as Medsea estates have not replied to my e-mail.

We may be naive, but Atlas assured us that they only deal with legitimate builders, and that they had checked that all licences were in place. Certainly, they did not take us to any of the 'problem sites' so we tended to trust them - but we did not look any further ourselves. Best wishes, Linda

And I have just read that there are 2000 potentially illegal builds in the Almanzora region - including 11 in Albox already declared illegal. Liinda

Hi Linda.You,ve probably read the same posts that caused the disquiet which made me ask the question a few nights ago .To reassure myself & also anybody else who is worrying, i quoted that perhaps the pedigree of the people now living on Huerta Nueva--Jacaranda etc--would have made any illegalities known to Los Olivos.

To enlarge on pedigree---Michelle & relative, young lady who works in our solicitors, Kevin ,who showed &recommended Los O. & has now left Parador & is working for similar company--I think that all these people are in a position to be aware of  possible difficulties & would not have bought..

I would not imagine Linda that you are naive,just a decent intelligent person who reasonably trusts the professionals with whom you;re dealing, & i think this would apply, myself included, to most of our fellow buyers.

Hi All

In reply to Neil and Chris, our lawyer confirmed to us that planning permission has definitely been granted for Los Olivos.  In fact, he was quite adament that we didn't sign our contract until he could confirm that to us.  He did so we signed!

Hi All - to back-up Jos's reply :  we were reassured by the couple from Atlas who showed us round on the inspection visit that the build had full planning permission and we had no reason to doubt this. Subsequently our lawyer was also adamant that he needed to check himself before we signed any contract - this was done and so everything is hunky-dory in this respect.

My mum is currently staying on HN for the month of November. She has spoken to the builders and the office there is still claiming that completion will be the end of December. She is not convinced and looking at the site - some apartments are still not rendered yet etc, she cannot see this happening. The builders could not answer the question 'at what point in time will you say that the completion will not be the end of Decemeber?', which isn't much use. It appears from this notice board that there is more information drifting out than the builders will tell my mum to her face!

Her solicitor has been in touch to sort out her NIE(?) number so they feel that there is still good progress.

On a happier note(!), my mum has said that the veiws are fantastic and the weather is still good!

Hi all. Spoke to Michelle yesterday who confirmed that Dec 31 was still on.

She also said that an interesting letter was on the way? Also that the numbers we have are plot numbers ¬ necessarily our address numbers.

Spoke to our Parador Owners Club rep who again confirmed Dec 31 & that all legal niceties in place.Once again reassured???????

I think reassured re the legality - I think we can all be confident. Still not convinced re completion - but fingers crossed. I can also confirm that when you buy a new build in England - you have a plot number, which is usually not your final address number!!! Makes things very confusing - but normal. My guess now is that if they are going to use their right to delay - they will have to let us know at the start of next month. But maybe the interesting letter will give us more info???? So, the 'interesting' letter from Michelle at BMS just reiterates what they've been saying all along i.e. completion of build process at end Dec. What a surprise !!
Looks like they're going to have to pull out all the stops to get everything ready for inspections in January.
We're still planning/hoping to complete at the end of March....

Hi All

I think the main purpose behind Michelle's e mail is to try and sell the builders mortgage to us. I suppose this would ease the transfer, but BMS will have tailored the mortage for their requirements with a much shorter repayment period etc. I would hazard a guess that this will not be suitable for all the residents, although we await the terms.

Hi all.Spoke again yesterday to Michelle who insisted that she had no reason to change the Completion date.We realistically believe ( & hope) that we may have completed by end of Feb.This is why we have rented an apartment on nearby Valle del Este from Jan 7 to March 7(also to get away from our lousy weather)

I cannot understand why at this stage .if there is a delay,which we all agree & accept,she lays herself open to hostile criticism,particularly as she lives on Huerta Nueva & can see the progress everyday.We have always found her very accommodating with a pleasant manner., so perhaps hers is a genuine belief or she knows something that we don,t
